**As of Sept. 28, 2021, the project has not yet been awarded. A timeline for award has not yet been established.** Small Business Goal for this Bid Package is 30%. Deadline for receiving final ITB bidder questions is September 8, 2021 at 12:00 PM noon. Answers to questions will be provided via Addendum by September 10, 2021 by end of business day. The work is to be performed under a Community Development Agreement between Hamilton County and The Greater Cincinnati Building & Construction Trades Council. Labor wage rates shall be the higher of either the individual union wage sheets or State of Ohio Prevailing Wage. The estimated budget will be sent in Addendum #1. As bid security, Bidders shall submit with their bid a Bid Guaranty in the form of either (1) a combined Guaranty and Contract Bond, or (2) a certified check, cashier's check drawn on a solvent bank, or an irrevocable letter of credit. If a Bid Guaranty and Contract Bond is submitted with the Bid, it shall be for the full amount of Bidder's bid, including alternates. If a certified check, cashier's check or irrevocable letter of credit shall be in the amount of 10% of the bid amount including Base Bid and Alternates. If a certified check, cashier's check drawn on a solvent bank, or an irrevocable letter of credit is submitted, it shall be payable to the Board of County Commissioners of Hamilton County, Ohio. The Bid Guaranty, in either form, must be in strict compliance with Section 153.54 of the Ohio Revised Code, and also Sections 153.57 or 153.571, as applicable. The Board of County Commissioners of Hamilton County, Ohio shall be named as obligees on the Bid Guaranty and Contract Bond. A successful bidder submitting a certified check, cashier's check or irrevocable letter of credit as bid security shall be required to furnish and pay for a Contract Bond in accordance with Ohio Revised Code Section 153.57 and the Instructions to Bidders. The Contract Bond must be the amount of 100% of the successful bidder's Contract amount. The Board of County Commissioners of Hamilton County, Ohio shall be named as Obligees on the Contract Bond. Bidders shall comply with Ohio Revised Code Section 153.59 to ensure that in the hiring of employees for the performance of work under the contract or any subcontract, no contractor, subcontractor, or any person acting on a contractor's or subcontractor's behalf, by reason of race, creed, sex, disability or military status as defined in section 4112.01 of the Revised Code, or color, shall discriminate against any and all employees and applicants for employment. In addition, Bidders shall comply with equal employment opportunity (EEO) requirements not to discriminate and to take affirmative action to assure equal opportunity as set forth under laws, executive orders, rules, regulations (28 CFR 35, 29 CFR 1630 and 41 CFR 60) and orders of the Secretary of Labor as modified by the provisions prescribed herein, and imposed pursuant to 23 U.S.C. 140 shall constitute the EEO and specific affirmative action standards for the contractor's project activities under this contract. The Equal Opportunity Construction Contract Specifications set forth under 41 CFR 60-4.3 and the provisions of the American Disabilities Act of 1990 (42 U.S.C. 12101 et seq.) set forth under 28 CFR 35 and 29 CFR 1630 are incorporated by reference in this contract. The Board of County Commissioners of Hamilton County, Ohio reserves the right to reject any or all bids, to waive any irregularities or informalities in bidding, and to withhold final awarding of the contract for sixty (60) days after the opening of bids. Location - NE corner of the intersection of Center Parkway and Elder Street SBE Goal - 30%
