PROJECT DESCRIPTION: Above and below grade excavation and construction of a new fire station for Madera County. All site work within the property line. All work shown in the drawings and specifications. CONTRACTORS LICENSE: The Contractor shall posses a valid California Class B license at the time this Project is bid. Each bidder shall be a licensed contractor pursuant to the Business and Professions Code and shall be licensed in the appropriate classification(s) of contractor's license(s), for the work bid upon, and must maintain the license throughout the duration of the Contract. QUESTIONS: All contractual and technical questions should be directed to the, Project Manager, Maritza Rodriguez maritza.rodriguez@maderacounty.com. Questions shall be submitted on the "REQUEST FOR CLARIFICATION" form provided in the Contract Documents. PAYMENT AND PERFORMANCE BOND: The successful bidder will be required to furnish the County with a Performance Bond equal to 100% of the successful bid, and a Payment Bond equal to 100% of the successful bid, prior to execution of the Contract. All bonds are to be secured from a surety company that meets all of the State of California bonding requirements, as defined in Code of Civil Procedure Section 995.120, and is authorized by the State of California, and all documents required by Code of Civil Procedure Section 995.660, to the extent required by law. SUBSTITUTION OF SECURITIES: Pursuant to the provisions of Public Contract Code Section 22300, the successful bidder may substitute certain securities for funds withheld by County to ensure his performance under the Contract. At the request and expense of the successful bidder, securities equivalent to any amount withheld shall be deposited at the discretion of County, with either County or a state or federally chartered bank, as the escrow agent, who shall then pay any funds otherwise subject to retention to the successful bidder. Upon satisfactory completion of the Contract, the securities shall be returned to the successful bidder. PREVAILING WAGES: The Director of Industrial Relations has determined the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the Contract which will be awarded to the successful bidder, copies of which are on file and will be made available to any interested party upon request. A copy of these rates shall be posted at the job site. It shall be mandatory upon the bidder to whom the Contract is awarded, and upon any subcontractor under him, to comply with all Labor Code provisions, which include, but are not limited to the payment of not less than the said specified rates to all workers employed by them in the execution of the Contract, employment of apprentices, hours of labor and debarment of contractors and subcontractors. WITHDRAWAL OF BIDS: The County reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding. No bidder may withdraw his/her bid for a period of one hundred twenty (120) days after the date set for the opening thereof. BID SELECTION: The County shall award the Contract for the Project to the bidder submitting the responsive lowest bid as determined from the base bid and is deemed responsible by the County. CONSTRUCTION TIME: The successful CONTRACTOR (after receiving the Notice to Proceed) shall have two hundred forty-two (242) calendar days to complete all work called for under the Contract Documents. LIQUIDATED DAMAGES: The liquidated damages will be $1000.00 per day for the project delays that are determined to be attributable to the CONTRACTOR.
