All questions must be submitted in writing by 5:00 p.m. on Wednesday, September 22, 2021 to Ken Herman at kherman@fmwd.com. Bidder shall be licensed in accordance with the California Contractors State License Board and possess a current and active Class C33 Painting contractor's license with a minimum of 5 years' experience in the type of work specified. As a minimum, Bidder shall have successfully completed work on at least four distribution, pumping, or potable water treatment facilities for public agencies within the past five years. In addition, Bidder shall not have been barred from any public contracts due to prior misconduct. Each bid shall be accompanied by cash, a certified or cashier's check, or bid bond issued by a surety or sureties admitted in and regulated by the State of California (bid bond shall be submitted on the form attached herein or on an equivalent form approved by the District) for an amount not less than 10% of the maximum amount bid. The successful bidder, simultaneously with the execution of the agreement, shall furnish and maintain a payment bond in an amount equal to 100% of the contract price and a faithful performance bond in an amount equal to 100% of the contract price. The bonds shall be secured from a surety company satisfactory to the District and whose name is on file with the California Department of Insurance as an approved and financially sound surety company, authorized to transact business in this State. Pursuant to California Labor Code Section 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the Work is to be performed. Copies of these determinations, entitled "Prevailing Wage Scale", are maintained at the District's Office and are available to any interested party upon request. The Contractor to whom the contract for Work is awarded shall post a copy of all applicable prevailing wage rates for the Work at conspicuous locations at the site of the Work. The Contractor and all Sub-contractors performing any portion of the Work shall pay not less than the applicable prevailing wage rate for the classification of labor provided by their respective Workers in the execution of the Work. The schedule of per diem wages is based upon a Working day of eight (8) hours. The rate for holiday and overtime Work shall be at time and one-half. Any excavation five feet or deeper requires the submission of a separate shoring plan and an itemized bid. In all respects, the successful bidder shall comply with requirements of law pertaining to public works contracts. The District may reject proposals and waive irregularities or informalities in any of the proposals. Each proposal shall be submitted only on the prescribed proposal form included with the contract documents.
