The Contractor shall achieve Substantial Completion of the Work within 500 calendar days from the date of commencement stated in the written Notice to Proceed. A Contractor submitting a bid acknowledges that the time for completion of the Work is sufficient for it to perform all the Work. The last day to submit questions: September 20, 2021 5:00 PM The City and the Contractor agree that the City will incur damages for inconvenience and delay if the Contractor fails to achieve Substantial Completion within the time period set forth in this Invitation to Bid or as may be amended in accordance with the terms of the Contract. The parties further acknowledge that the damages which might be reasonably anticipated to accrue as a result of such failure are difficult to ascertain due to their indefiniteness and uncertainty. Accordingly, the Contractor agrees that it will pay liquidated damages in the amount of $1,000 per calendar day for each day the Contractor is late achieving Substantial Completion, provided that such liquidated damages will not begin to accrue until after the Substantial Completion date. The City has established the following CBI Goal(s) for this Project: Small Business Enterprise ("DBE") Goal 5.00% Minority Business Enterprise ("MBE") Goal 5.00% Pre-Bid Conference: Attendance at the Pre-Bid Conference is not mandatory, but is strongly encouraged. Please allow time for this procedure as the Pre-Bid Conference and Bid Opening times can NOT be changed for any reason. Preferred brand alternates, to the extent applicable, will be addressed at the Pre-Bid Conference. Each Bid shall be accompanied by a Bid security in the form of, at Bidder's option, cashier's check, certified check, money order or bid bond (in favor of the Owner) in the amount of 5% of the Base Bid amount pledging that the Bidder will, after notice of award, enter into a Contract with the Owner on the terms stated in its Bid and will furnish bonds as described in Contract Documents, covering the faithful performance of the Contract and the payment of all obligations arising thereunder. A site tour may be conducted immediately after the Pre-Bid Conference. The OWNER will have the right to retain the Bid security of Bidders to whom an award is being considered until either (a) the Contract has been executed and bonds have been furnished; (b) the specified time has elapsed so that Bids may be withdrawn, or (c) all Bids have been rejected. The Owner reserves the right to reject any and or all Bids.
