Ballfield Reconstruction & Park Improvements Amesbury High School & Amesbury Town Park Amesbury, MA Proposals sent through the mail shall be marked "BALLFIELD RECONSTRUCTION & PARK IMPROVEMENTS AMESBURY HIGH SCHOOL & AMESBURY TOWN PARK - Bid Proposal". In general, the work of this project at Amesbury Town Park includes removal and disposal of existing baseball field amenities including but not limited to backstops, bleachers, and fencing, removal and disposal of asphalt pavements, clearing and grubbing of trees, stripping and stockpiling of topsoil, furnishing and installation of baseball field backstops, fencing, dugout roof structures, scoreboards, field lighting, irrigation systems and spectator bleachers, construction of new paved parking areas and concrete walks, installation of new tree plantings. The work of this project at Amesbury High School associated with the baseball field includes installation of a gravel filled French drain, clearing and grubbing of vegetation around the existing backstop, limited removal of turf and regrading of the field, core aeration of the existing grassed areas and a sand top-dressing. Construction for this project shall begin October 2021 and completed as specified within Contract Documents. The bidding for and award of the contract for this project are to be in accordance with the requirements of Massachusetts General Laws Chapter 30 39M. Bidders are on notice that this project is subject to the schedule of prevailing wage rates as determined by the Commissioner of the Massachusetts Department of Labor and Workforce Development, Division of Occupational Safety, and applicable Federal Regulations. The Proposal Guaranty shall be in the form of either cash, bid bond, certified check, bank treasurer's check, or bank cashier's check, made payable to the City of Amesbury in the amount of 5% of the value of the bid. Proposals that do not include a properly completed "Affidavit" pertaining to the non-collusion, etc., will be declared non-responsive and not eligible for award consideration. No Bidder may withdraw his bid for a period of thirty days, excluding Saturdays, Sundays and legal holidays after the actual date of an opening of bids. Successful bidder must furnish 100 percent Construction Performance Bond and 100 percent Construction Payment Bond with a surety company acceptable to the Owner. The Owner reserves the right to waive any informality and to reject any or all bids if it is in the public interest to do so. The Owner reserves the right to decrease the scope of the work to be done under this contract and to omit any work in order to bring the cost within available funds. To this end, the Owner reserves the right to reduce the quantity of any items or omit all of any progress of work. The Owner further reserves the right, at any time during the progress of the work, to restore all or part of any items previously omitted or reduced. Exercise by the Owner of the above rights shall not constitute any ground or basis of claim for damages or for anticipated profits on the work omitted. The Owner may at any time, as the need arises, order changes within the scope of the Work without invalidating the Contract. If such changes increase or decrease the amount due under the Contract Documents, or in the time required for performance of the Work, a Change Order shall authorize an equitable adjustment. The Owner must confirm in writing any explanation or interpretation of Drawings or Specifications altering or varying the Work, made by an employee of the Owner, before such changed Work is acted upon by the Contractor. The Engineer, also, may at any time by issuing a Field Order make changes in the details of the Work. The Contractor shall proceed with the performance of any changes in the Work so ordered by the Engineer, unless the Contractor believes that such Field Order entitles the Contractor to a change in the Contract Price, or time, or both, in which event the Contractor shall give the Engineer written notice thereof within seven (7) days after receipt of the ordered change. Thereafter, the Contractor shall document the basis for the change in Contract Price or time within thirty (30) days. The Contractor shall not execute such changes pending receipt of an executed Change Order or further instruction from the Owner.
