All bids must be submitted in accordance with forms and conditions set forth in the Bidding Documents. Project consists of modifications of an existing box culvert, earthwork, and related appurtenances. Pursuant to Section 292.675, RSMO, the Contractor shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for all on-site employees. Pursuant to Section 292.675, RSMO, the Contractor shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for all on-site employees It is mutually understood and agreed by and between the parties to this contract, in the execution ofthe same, that TIME IS OF THE ESSENCE OF THE CONTRACT. In the event that the Contractor shall fail to complete the work to be performed under this contract by and at the completion time bid in the Proposal, the Contractor shall pay unto the Owner as and for liquidated damages, and not as a penalty, the sum of Five Hundred Dollars ($500.00) for each and every working day that the Contractor shall be in default. Extensions of time granted by the Owner in accordance with the provisions of Article FC-33 shall operate to waive the liquidated damages during and over the period of such time extension duly authorized by the Owner.
