Prospective BIDDERS shall be skilled and regularly engaged in the general class or type of WORK called for under the CONTRACT. In accordance with Section 7040(b) of the Business and Professions Code, no BID will be considered for award unless the BIDDER certifies at the time of award that he or she is a Class C57 contractor, licensed in the State of California to enter into contracts to perform the specified class or type of WORK. All applicable federal, state and local laws, codes and ordinances must be complied with. Each Bidder must deposit with his bid, security in the amount, form and subject to the conditions provided in the INSTRUCTIONS TO BIDDERS. The Owner reserves the right to waive any informalities or to reject any and all bids. No Bidder may withdraw his bid within ninety (90) days after the actual date of the opening thereof. The Owner hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award. Minimum wage rates for this project, as predetermined by the Secretary of Labor, are set forth in the Special Provisions. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate. In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. Said wages are on file with the Clerk of the County of Madera, California, and are incorporated herein by reference. A Bid must be accompanied by Bid security made payable to OWNER in an amount of ten percent (10%) of Bidders maximum Bid price and in the form of a certified or bank check or a Bid Bond (EJCDC No. 1910-28-C, 1996 Edition) issued by a surety meeting the requirements of paragraphs 5.01 and 5.02 of the General Conditions.
