Participation Bidders are invited to participate in the site visit offered by the public body. Failure to participate may not be used as an excuse or pretext for errors, omissions or irregularities on the part of a tenderer. Each tenderer is responsible for delegating a representative to this meeting. In addition, the public body assumes no responsibility with respect to bidders who did not show up for the site visit in relation to the information that may have been given during it. Diffusion If necessary, the public body sends the list of points raised during the visit as well as its responses to all bidders by way of an addendum. In the event of a discrepancy between the verbal exchanges during this visit and the tender documents, the latter take precedence. Equivalent submission Estimate The characteristics of the materials and the description of the work sought by the public body are indicated in the estimate. The tenderer may, however, propose during the invitation to tender different materials or a process or an execution method different from those requested, provided that the characteristics of these materials or of this process or this method are equivalent or superior to those indicated in the estimate. Equivalence If applicable, the tenderer must submit to the public body a request for equivalence in accordance with clause 1.04. This request must be sent to the public body at least two hundred and forty (240) hours before the date and time set for the receipt of submissions. Any request for equivalence must include a description of the materials or process or method proposed as well as any other relevant information. The request must be sufficiently documented for the public body to be able to assess it. It is the responsibility of the tenderer to prove the equivalence and to comply with the process prescribed by the public body for this purpose. All costs associated with the demonstration of equivalence are the responsibility of the tenderer. Decision The public body renders its decision by issuing an addendum. Only equivalences that have been authorized by addenda are considered by the public body when studying the compliance of the submissions. Any decision as to an equivalence is at the sole discretion of the public body. Eligibility To be admitted to tender, a tenderer: A) must have the necessary qualifications, authorizations, permits, licenses, registrations, certificates, accreditations and attestations; B) must have, in quebec or in a territory covered by an applicable intergovernmental agreement, an establishment where it carries out its activities on a permanent basis, clearly identified with its name and accessible during normal office hours; C) having an establishment in quebec must hold, at the time of submitting his submission, a valid certificate from revenu québec that has not been issued after the date and time limit for receipt of the submission; D) who do not have an establishment in quebec must submit, with their submission, the form absence establishment in quebec duly completed and signed; E) must, at the time of submitting the bid, hold an authorization to contract amp, when required by reason of the amount of the bid; F) must not, at the time of submitting its submission, be registered in the register of enterprises not eligible for public contracts (rena) or, if it is registered there, be in a period of ineligibility; The register of non-eligible companies (rena) can be consulted on the website of the autorité des marchés publics at the following address: https://amp.Gouv.Qc.Ca/rena/. Of the act respecting contracting by public bodies (cqlr, c. C-65.1). G) must have produced with its tender the form certificate relating to the probity of the tenderer duly completed and signed; H) must have produced with its submission the form declaration concerning lobbying activities duly completed and signed; I) must comply, where applicable, with any other eligibility condition indicated in the invitation to tender documents. Failure of a bidder to meet any of these conditions renders it ineligible. Discretionary rejection The public body reserves the right to reject the submission of a tenderer who, within two (2) years preceding the opening of the submissions, has: A) has been the subject of an unsatisfactory performance evaluation by the public body; B) failed to follow up on a bid or contract; where C) is the subject of a contract termination due to failure to comply with the conditions.
