The Scope of Work includes removal of existing concrete dam and placement of permanent erosion control items, grading, drainage pipes, plantings, and other incidental items to recreate a natural channel. A bid security in the amount of five percent (5%) of the bid amount must accompany each bid in accordance with the Instructions to Bidders. The City of Town and Country reserves the right in its sole discretion to reject any and all proposals, to waive technicalities or deficiencies in any or all the proposals, to negotiate with any or all bidders or others for other or more favorable terms or prices, and/or to award the contract to other than the bidder submitting the lowest cost proposal, with or without negotiation. The Contractor, acting as an independent contractor, shall do everything required by the Contract Documents and shall timely complete the project in strict compliance with all requirements and specifications set forth in the Contract Documents. Contractor represents and warrants that he has special skills which qualify him to perform the Work in accordance with the Contract and that he is free to perform all such Work and is not a party to any other agreement, written or oral, the performance of which would prevent or interfere with the performance, in whole or in part, of the Work. All work shall be performed in compliance with all applicable federal, state, The Contractor shall furnish all labor, materials and equipment necessary to perform the scope of work within the project limits.
