Each bid shall be accompanied by a certified check, cashiers check or bid bond duly executed by the bidder as principal and having as surety thereon a surety company approved by the City of Linwood in an amount not less than ten percent but in no case in excess of $20,000.00 of the amount bid. Any such bid bond shall be without endorsement or conditions. Bid shall also be accompanied by a certificate letter from a surety company stating that it will provide the bidder with the completion bond. The award of the contract shall be made subject to the necessary moneys being available by the City of Linwood in a lawful manner. The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys have been provided by the City of Linwood in a lawful manner. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 and N.J.A.C. 17:27 et seq. In accordance with P.L. 2004, c. 56, N.J. BUSINESS REGISTRATION ACT, all bidders must submit a copy of their proof of registration, and that of all listed or named subcontractors, as part of their bid submission. Starting in January 2007, all business entities are advised of their responsibility to file an annual disclosure statement of political contributions with the New Jersey Election Law Enforcement Commission (ELEC) pursuant to N.J.S.A. 19:44A-20.27 if they receive contracts in excess of $50,000 from public entities in a calendar year. Business entities are responsible for deter-mining if filing is necessary. Additional information on this requirement is available from ELEC at 888-313-3532 or at electronically. The City of Linwood reserves the right to consider the bids for sixty (60) days after the receipt thereof, and further reserves the right to reject any and all bids, either in whole or in part and also to waive any informality in any and make such awards or take action as may be in the best interest of the City of Linwood.
