Replat of Lots 3 & 4 Block a Siena South, Section 1 Drainage, Water, & Wastewater Improvements The bid is for all the Improvements for the project, which includes all labor, equipment, and other necessary appurtenances to construct the project. Bids must be submitted on the form included in the bid documents, in a sealed envelope marked "Bid for Replat of Lots 3 & 4 Block A Siena South, Section 1 Drainage, Water, and Wastewater Improvements." Prospective bidders are required to submit Statements of Qualification no later than 5 calendar days prior to the scheduled bid opening, unless a Qualification has already been submitted for a previous Siena project. Qualification forms are included in the bid documents. Failure to submit the required Statement of Qualification as required will be sufficient cause to reject a contractor's bid. Should a bidder find discrepancies in, or omissions from the plans, specifications, or other documents, or should be in doubt as to their meaning, the Engineer shall be notified, and clarification obtained prior to submitting any bid. A Cashier's Check or Certified Check upon a national or state bank or Bid Bond payable to Sommery Lot 3, L.P., in an amount not less than two percent (2%) of the total bid (Bidder's Check or Bid Bond), must accompany the bid proposals as a guarantee that, if awarded the contract, the bidder will within ten (10) days of the award of the contract, enter into a contract and furnish an acceptable performance and payment bond in the amount of one hundred percent (100%) of the contract price. The Bidder's Check or Bid Bond will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within ten (10) days after award of the contract. The notice of award of contract shall be given by the Owner within sixty (60) days after the bid opening. The Bidder's Check or Bid Bond must be enclosed in the same envelope as the bid. Bids without a Bidder's Check or Bid Bond will not be considered. All bid securities will be returned to the respective bidders within seventy-two (72) hours after bids are opened, except the three most qualified bidders, which the Owner elects to hold until the successful bidder has executed the contract. Thereafter, all remaining securities, including security of the successful bidder after entering into a contract, will be returned within forty five (45) days of the notice of award. The successful bidder must furnish performance bond and payment bond in the amount of one hundred (100%) percent of the contract price from an approved surety company holding a permit from the State of Texas to act a surety (and acceptable according to the latest list of companies holding certificates of authority from the Secretary or the Treasury of the United States) and having Best Key Rating Guide of A or better. No proposals shall be withdrawn for a period of sixty (60) days after the opening of the bids. The Owner reserves the right to reject any and/or all bids and to waive all formalities in the bidding process. The Owner also reserves the right to determine which bid is most advantageous, and to award the contract on this basis. The Owner also reserves the right to award individual sections as separate Contracts, or to award any combination of sections, or to award to separate contractors. A maintenance bond to Williamson County will be required for ten percent (10%) of the streets, drainage, and erosion control amounts and is to remain in force for a period of two (2) years from the date of final acceptance from Williamson County. A maintenance bond to Jonah Water S.U.D. will be required for twenty percent (20%) of the water amount and is to remain in force for a period of two (2) years from the date of final acceptance from Jonah Water S.U.D. A maintenance bond to Siena MUD1 will be required in the amount of ten percent (10%) of the drainage, water, and wastewater amount and is to remain in force for a period of one (1) year from the date of final acceptance from Siena MUD1. Contractors must be plan holders/reviewers of record and must attend the mandatory pre-bid meeting to be eligible to submit a bid.
