KATY ISD requests a lit or dark fiber solution to connect the District new campuses to the District Data Center and to an associated Hub site for IPOP connectivity. Questions Due Date: Dec 3rd 2021, 10:00 AM CST Intent to Bid Due Date: Dec 20th 2021, 10:00 AM CST Questions and Clarification a) Questions regarding the requirements specified in this solicitation must be submitted within the KATY ISD Bonfire System. b) KATY ISD will not answer verbal questions; any responses to a prospective vendor's questions will be posted within the KATY ISD Bonfire System. This portion of the CSP includes instructions on the format vendors must follow in preparing and submitting their responses. It further identifies how questions should be raised and will be addressed. Vendors are required to respond to all requests identified in this CSP and indicate their acceptance or objection to the terms of the CSP. Any exceptions to the terms, conditions and/or specifications shall be conspicuously noted by the Vendor in writing on the provided deviations form and shall be included with the response. Each vendor, by submitting a response, represents that they have read and understand the CSP. KATY ISD is committed to reducing waste and promoting energy conservation. Toward that end, vendors responding to this solicitation are encouraged to provide their company's environmental policy and green initiative. A Proposal Bond from a bonding company acceptable to the Owner in an amount equal to 10% of the greatest amount proposal must accompany each Offeror's proposal. A Payment Bond and Performance Bond, each in an amount equal to 100% of the Contract Sum conditioned upon the faithful performance of the Contract will be required. Please note that all bonding companies presented must be acceptable to the Owner. As written in Texas Government Code 2258.021: " (a) A worker employed on a public work by or on behalf of the state or a political subdivision of the state shall be paid: (1) not less than the general prevailing rate of per diem wages for work of a similar character in the locality in which the work is performed; and (2) not less than the general prevailing rate of per diem wages for legal holiday and overtime work. (b) Subsection (a) does not apply to maintenance work. (c) A worker is employed on a public work for the purposes of this section if the worker is employed by a contractor or subcontractor in the execution of a contract for the public work with the state, a political subdivision of the state, or any officer or public body of the state or a political subdivision of the state. As written in Texas Government Code 2258.023: 1) The contractor who is awarded a contract by a public body or a subcontractor of the contractor shall pay not less than the rates determined under Section 2258.022 to a worker employed by it in the execution of the contract. 2) A contractor or subcontractor who violates this section shall pay to the state or a political subdivision of the state on whose behalf the contract is made, $60 for each worker employed for each calendar day or part of the day that the worker is paid less than the wage rates stipulated in the contract. A public body awarding a contract shall specify this penalty in the contract. 3) A contractor or subcontractor does not violate this section if a public body awarding a contract does not determine the prevailing wage rates and specify the rates in the contract as provided by Section 2258.022. 4) The public body shall use any money collected under this section to offset the costs incurred in the administration of this chapter. 5) A municipality is entitled to collect a penalty under this section only if the municipality has a population of more than 10,000. KATY ISD reserves the right to cancel this solicitation in whole or in part by issuance of a revised or amended Competitive Sealed Proposal. KATY ISD further reserves the right to award one or more contracts, in part or in whole, to a single or to multiple prospective vendors. The decision to award multiple contracts, award only one contract, or to make no awards rests solely with KATY ISD. KATY ISD may make multiple awards, and this fact should be taken into consideration by each vendor. The estimated expenditure for this project is $195,000.00.
