Project Description: Removal and replacement of approximately 2,900 water meters of various sizes within city water service area with smart technology meters, and, change out meter box lids. Work shall be completed within 240 days from the date when Contract Time commences to run. 1.03 Engineer's Estimate. The Engineer's Opinion of Probable Costs is approximately $2,156,128.00. 1.04 Procurement of Bidding Documents: Bidding Documents contain the full description of the Work. Bidders may examine a complete hard-copy set of the Bidding Documents at the Fort Bragg City Hall, located at 416 North Franklin Street, Fort Bragg, California 95437, upon making advance arrangements. Instructions: Bidders shall refer to Instructions to Bidders Paragraph 1.01 for required documents and items to be submitted. Bid Preparation Cost: Bidders are solely responsible for the cost of preparing their Bids. Reservation of Rights: City specifically reserves the right, in its sole discretion, to reject any or all Bids, to re-bid, or to waive inconsequential defects in bidding not involving time, price or quality of the work. City may reject any and all Bids and waive any minor irregularities in the Bids. ARTICLE 2 - LEGAL REQUIREMENTS Required Contractor's License(s): A. A California class A contractor's license is required to bid this contract. Joint ventures must secure a joint venture license prior to award of this Contract. Specialty work may require a specialty class A (contractor's license) held by Bidder or a listed subcontractor. Required Contractor and Subcontractor Registration A. City shall accept Bids only from Bidders that (along with all Subcontractors listed in Subcontractors List) are currently registered with the Department of Industrial Relations ("DIR") and qualified to perform public work pursuant to Labor Code Section 1725.5. B. Subject to Labor Code Sections 1771.1(c) and (d), any Bid not complying with paragraph A shall be returned and not considered; provided that if Bidder is a joint venture (Business & Professions Code Section 7029.1) or if federal funds are involved in the Contract (Labor Code Section 1771.1(a)), City may accept a non-complying Bid provided that Bidder and all listed Subcontractors are registered at the time of Contract award. Substitution of Securities: City will permit the successful bidder to substitute securities for any retention monies withheld to ensure performance of the contract, as set forth in Escrow Agreement for Security Deposits in Lieu of Retention and incorporated herein in full by this reference, in accordance with Public Contract Code Section 22300. Prevailing Wage Laws: The successful Bidder must comply with all prevailing wage laws applicable to the Project, and related requirements contained in the Contract Documents. Copies of the general prevailing rates of per diem wages for each craft, classification, or type of worker needed to execute the Contract, as determined by Director of the State of California Department of Industrial Relations, are on file at the City's Public Works Department, may be obtained from the California Department of Industrial Relations portal and are deemed included in the Bidding Documents. Upon request, City will make available copies to any interested party. Also, the successful Bidder shall post the applicable prevailing wage rates at the Site. Prevailing Wage Monitoring: This Project is subject to prevailing wage compliance monitoring and enforcement by the Department of Industrial Relations. Federal Prevailing Wage Provisions: The project is partially funded by State Community Development Block Grant (CDBG) funds, which carry with them both Federal and State requirements, including Federal Prevailing Wage. Each worker classification must be compared for its State Prevailing Wage and its Federal Prevailing Wage, including fringe benefits for each. The higher of the two wages must be paid. The City will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determinations otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question.
