A payment and performance bond, each in the amount of one hundred percent (100%) of the contract price, will be required of the successful proposer, conditioned on the faithful performance of the contract, payment of all persons supplying labor or furnishing materials, and payment of all liabilities incurred in connection with the work of this contract. Each bond must be supplied in compliance with State law. Each bond should be valid for one year beyond the date of final acceptance of the complete project. Attention of proposer is particularly called to the fact that not less than the federally determined prevailing wage rate (Davis-Bacon Act), as issued by the US Department of Labor and as set forth in the contract documents, must be paid on this project, and that the contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, marital status, handicap, or national origin. The District reserves the right to reject any and all proposals, to waive irregularities, formalities, to require financial statements and references, and to accept the bid considered most advantageous to the District. Proposals may be held by the Owner for a period not to exceed ninety (90) calendar days from the date of the opening of proposals, for the purpose of reviewing the proposals and investigating the qualifications of proposers, prior to awarding the contract.
