Bids shall be accompanied by a cashier's check or certified check upon a national or state bank in an amount not less than five percent (5%) of the total maximum bid price payable without recourse to the City of Sherman, or a bid bond in the same amount from a reliable surety company licensed by the State of Texas to act as a Surety and be listed on the current U.S. Treasury Listing of Approved Sureties, or a Binder of Insurance executed by a surety company licensed by the State of Texas to act as a surety or its authorized agent as a guarantee that the bidder will enter into a contract and execute a Performance Bond within ten (10) days after notice of award of contract to bidder. The right is reserved by the Mayor and the City Council as the interests of the City may require to reject any or all bids and to waive any informality in bids received. The Bidder must supply all the information required in the Bid Form. The successful bidder shall furnish to the OWNER upon notice of award a performance bond, labor and material payment bond, and one (1) year maintenance bond in the amount of one hundred percent (100%) of the total contract price, once the project is complete. Bonds shall be submitted by a surety company specifically approved in writing from the OWNER holding a permit from the State of Texas to act as a surety, or other sureties acceptable to the OWNER. Said statutory bonds should be issued by a company carrying a current Best Rating of "A" or better. The name of the surety company shall be clearly written on the exterior of the sealed bid. Projects shall include all necessary labor, materials, and testing in accordance with the plans and specifications.
