The bid bond or certified check shall be returned or refunded to the bidder on the condition that if the bid is accepted by the Owner, the bidder shall enter into a contract for the same, within ten (10) days after notification of award of contract. If no contract is awarded within 45 days of submittal of the bid, the bid may be withdrawn and the bid bond or certified check shall be returned or refunded. Each proposal must be accompanied by an Offer of Surety (Schedule 1), signed by the bidder and by the proposed surety. No bids shall be withdrawn for a period of forty-five (45) days after the receipt thereof, without the consent of the Town Board of the Town of Newburgh.
