Any Bidder who wishes its bid to be considered is responsible for making certain that its bid is received in the City Clerk Office by the proper time. No oral, telegraphic, electronic, facsimile or telephonic bids or modifications will be considered unless specified. Bids received after the scheduled bid opening time will be returned unopened. The Bid Security shall be forfeited to the City of Hialeah Gardens as liquidated damages in the case of failure or neglect of the bidder to furnish, execute and deliver to the City of Hialeah Gardens the required performance bond, payment bond and evidences of insurance, and to enter into, execute and deliver to the City of Hialeah Gardens the contract on the form provided herewith, within ten (10) days after being notified in writing by the City of Hialeah Gardens that the award has been made and the contract is ready for execution. The Successful Bidder will be required to furnish a Performance Bond in an amount equal to one hundred percent (100%) of the total amount of the contract before commencement of work and conforming to the contract documents.
