Any contract awarded under this Invitation for Bids may be paid for in whole or in part with grant funding from the United States Department of the Treasury ("Treasury") and the Mississippi Department of Environmental Quality ("MDEQ") under the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE Act). Any contract resulting from this solicitation will be subject to the terms and conditions of the funding award, the RESTORE Act Financial Assistance Standard Terms and Conditions and Program-Specific Terms and Conditions, the Standard Sub-Award Terms and Conditions, the RETORE Act, 33 U. S. C. 1321(t), Treasury Regulations 31 C. F. R. 34 et seq., including 31 C. F. R. 34, Subpart D, all applicable terms and conditions in 2 C. F. R. Part 200 (including Appendix II to Part 200), and all other OMB circulars, executive orders or other federal laws or regulations, as applicable. Notwithstanding the above, neither MDEQ nor Treasury, or any of their agents, representatives, or employees, is or will be a party to this Invitation for Bids or any resulting contract. Further, any contractor awarded a contract under this Invitation for Bids shall not be deemed to be an agent, representative, employee or servant of MDEQ or Treasury. INFORMATION FOR BIDDERS RELATED TO RESTORE ACT FUNDING: MINORITY BUSINESS ENTERPRISE AND WOMEN'S BUSINESS ENTERPRISE (MBE/WBE) REQUIREMENTS: Documentation of compliance with the MBE/WBE requirements is a matter of contractor responsibility. When subcontracting, the contractor must submit documentation of good faith efforts to meet the project's MBE/WBE requirements before contracted work can commence; MBE/WBE requirements and required documentation are outlined in MDEQ Required Attachments Section of the Contract Documents. Failure on the part of the contractor to submit proper documentation may cause the Owner to not execute or to terminate the contract. DAVIS BACON AND RELATED ACTS: The Davis-Bacon Act and Related Acts are applicable to construction activities under this Contract. The prime contractor, all sub-contractors, and all lower-tier sub-contractors must comply with the Davis-Bacon Act (40 USC. 3141-3144, and 3146-3148) as supplemented by Department of Labor regulations (29 CFR Part 5, "Labor Standards Provisions Applicable to Contracts Covering Federally Financed and Assisted Construction") The Contract Work Hours and Safety Standards Act (29 CFR 5.5(b)) applies to this contract and the Copeland "Anti-Kickback" Act (40 USC. 3145), as supplemented by Department of Labor regulations (29 CFR Part 3, "Contractors and Subcontractors on Public Building or Public Work Financed in Whole or in Part by Loans or Grants from the United States") also applies to all work performed. Detailed information regarding compliance with the aforementioned labor standards is included in the MDEQ Required Attachments Section of the Contract Documents. See Appendix D of the Contract Documents for the applicable prevailing wage determination issued by the Department of Labor. The decision to award a contract or subcontract is conditioned upon the acceptance of this wage determination, which may be superseded by addendum. HUD Section 3 Program requirements and DBE requirements do not apply to this Contract. MISSISSIPPI FIRST ACT (Miss. Code Ann. 31-5-37): Contractors submitting bids for public works that involve an expenditure of Five Thousand Dollars ($5,000) or more that are financed with RESTORE Funds are subject to the hiring policies established by this section. Each contractor SHALL submit with their bid a certification that they will comply with the provisions if they are awarded a contract. Within seven (7) days after the award of the contract, the prime contractor must submit an employment plan to the OWNER and the Mississippi Department of Employment Security. Detailed Information regarding compliance with the aforementioned Mississippi First Act is included in the MDEQ Required Attachments Section of the Contract Documents. The right is reserved by the Owner to reject any or all bids, to waive any informalities, and to award the Contract to serve the best interest of Owner. By submitting a proposal, each bidder waives any and all claims for damages against Owner concerning any failure or decision of Owner to not accept the bid. The project includes installation of: a sewer forcemain consisting of 2,2.5-inch, PVC IPS pipe and some associated HDPE SDR 9 and SDR 13.5 o the service connection from the grinder pump vault to the new forcemain; o the 4-inch diameterservice connection from the structure to the grinder pump vault; o the electrical wiring and conduit from the post mounted grinder pump control panel to the structure's power supply The Work will be substantially completed within 180 days; General Conditions within 210 days after the date when the Contract Times commence to run.
