All bid questions and clarifications must be submitted to CMH by noon CST on January 10, 2022. Project number- 220065 CDBG-CV Project No. CV-NC-20-053 The project is being bid pursuant to the Alabama Public Works Law, Title 39 Code of Alabama 1975. The project is partially funded by CDBG-CV Project No. CV-NC-20-053. A cashier's check or Bid Bond payable to the Elmore County Commission, in an amount of not less than five (5) percent of the amount of the proposal, but in no event more than $10,000.00 must accompany the bid. Performance and Statutory Labor and Material Payment Bonds in the amount of 100% of the Contract Price will be required at the signing of the Contract. All Bids must be on a lump-sum basis. Submit three (3) copies of the Bid on the Bid Form provided, without changes, in a sealed envelope bearing the Contractor's name and current Alabama General Contractor license number. Bids that do not bear the Contractor's current license number on the outside of the envelope will be returned without being opened. Contractors shall submit the Post Bid Submittals per the Bid Form within 24 hrs. of the Public Bid Opening. The project is being bid EXCLUDING TAXES and requires the Contractor to comply with the requirements of Act 2013-205 which was signed into law May 19, 2013. The Contractor and the Owner will be required to apply for Certificates of Exemption with the Alabama Department of Revenue which will handle the administration of the certificates. The contractor shall account for the tax savings on the Accounting of Sales Tax form included in the specification behind the Bid Form. Failure of the Contractor to complete this form and include with their proposal shall render the bid non-responsive. Bid Submittal: Bids must be submitted on proposal forms furnished by the Architect or copies thereof. All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered. The Owner reserves the right to waive any informality or to reject any or all bids. Schedule: The successful bidder will be required to complete this work within 250 days after the Notice to Proceed has been issued by the Owner. Liquidated Damages: Apply to this project in the amounts specified in project manual refer to Information for Bidders, General Conditions and Supplemental Conditions. No bidder may withdraw his bid within 60 days after the actual date of the opening thereof. Non resident Contractors must accompany any written proposal documents with a written opinion of any attorney at law licensed to practice law in such non resident bidders' state of domicile, as to the preferences, if any or none, granted by the law of that state to its own business entities whose principal places of business are in that state in the letting of any or all public contracts. Bonds required by the Contract Documents shall be issued by a Surety Company licensed to do business in the State of Alabama having a bond rating of at least A- according to Best's Key Rating Guide, without reinsurance or other agreements to enhance its rating.
