WPE#:BS21006 Advertisement for Bids Owner: Minnehaha Community Water Corporation 47381 248th St. Dell Rapids, SD 57022 Notice is hereby given that Minnehaha Community Water Corporation will receive sealed bids for construction of MCWC 250,000 Gallon Water Tower No. 6A. Project scope will include the following: A 250,000 Gallon elevated water tower with a height to overflow of 170 feet and all piping, fittings, appurtenances and valves. The ground floor of the tower will be used as a storage facility and control room; Site work, yard piping, energy dissipation structure, culverts, gravel surfaced access road and parking area; All mechanical, electrical and control equipment necessary to provide a fully functioning facility; Corrosion protection system components including coatings, linings, and cathodic protection systems; Temporary and permanent erosion control, reclamation and seeding; Traffic control and haul road maintenance during construction; Reservoir and pipeline cleaning, flushing, hydrostatic pressure testing and disinfection; and Clean up, startup services, and all other miscellaneous work required but not herein mentioned but inferred from the construction Contract Documents. The Bids must be prepared on bid forms supplied in the Bidding Documents and filed with the Receptionist at the Office of Minnehaha Community Water Corporation, 47381 248th Street, Dell Rapids, SD 57022 not later than 1:30 pm, Local Time, January 20, 2022, at which time and place all Bids will be publicly opened and read aloud in the presence of the Bidders and their representatives. No bids will be received after the specified hour and date, and Bids which are not prepared and filed in accordance with "Instructions to Bidders" may be rejected. Each Bid must be submitted in a sealed envelope. Each sealed envelope containing a Bid must be plainly marked on the outside as Bid for MCWC 250,000 Gallon Water Tower No. 6A. The envelope should also bear on the outside the name and address of the Bidder. If forwarded by mail or other delivery system, the sealed envelope containing the Bid must be sealed in another envelope, with the notation "Bid Enclosed" on the face thereof, and addressed to Minnehaha Community Water Corporation, 47381 248th St., Dell Rapids, SD 57002. A pre-bid meeting will not be held. A complete set of paper Drawings, Specifications, and Bidding Documents may be ob!tained at the office of Banner Associates, Inc., 409 22nd Avenue South, P.O. Box 298, Brookings, SD 57006, (605) 692-6342 or may be ordered from www.bannerassociates.com upon non-refundable payment in the amount of $50.00 including taxes for each set of Bidding Documents. Electronic copies are also available and can be ordered and downloaded from the above website for a $25.00 non-refundable fee. Upon request, in accordance with South Dakota Codified Law 5-18B-1, one copy of electronic or paper Plans and Specifications shall be furnished, without charge, to each Prime Contractor resident in South Dakota who intends, in good faith, to submit a bid to the Owner. Additionally, if a paper copy is provided under the conditions of SDCL 5-18B-1, in consideration of the documents being provided at no charge, unsuccessful bidders agree to return the documents to the office of Banner Associates, at the address listed above, within thirty (30) days after the bid opening. The Bidder to whom the contract is awarded will be required to fur!nish a construction per!form!ance bond and a construction payment bond to the Owner in the amount of one hundred per!cent (100%) of the contract award for each bond, in con!form-ance with the requirements of the Contract Documents. The construction per!form!ance bond and construction payment bond shall remain in full force until the completion of the Con!tract as specified in the General Conditions. All bids must be accompanied by a Bid security. Bid security will take the form of a bid bond in an amount of ten percent (10%) of the Bidder's maximum Bid price or a cashier's or certified check made payable to Owner in an amount of five percent (5%) of the Bidder's maximum Bid price. The Bid security will be re!tained by the Owner if the suc!cess!ful bidder refuses or fails to enter into an Agreement within fifteen (15) days after Notice of Award or fails at time of execut!ing the con-tract to furnish a construction performance bond and construction payment bond guaranteeing the faithful per!form!ance of the work. Any contract or contracts awarded under this Advertisement are expected to be funded in part by a loan from the South Dakota State Revolving Loan Fund. Neither the State of South Dakota nor any of its departments, agencies or employees is or will be a party to this Advertisement or any resulting contract. This procurement will be subject to regulations contained in 40 CFR 35.936, 35.938 and 35.939. The successful bidder including any contractors and their subcontractors on the project, must be registered in SAM (System for Award Management). The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Davis-Bacon and related acts provisions apply to this project. All provisions relative to those acts must be met. NONDISCRIMINATION IN EMPLOYMENT (a) Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138 (WBE). The goals and other requirements for Bidders and Contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women's Business Enterprises (WBE) are explained in the Specifications. The MBE goal for this project is 1% of the total dollar value of the job while the WBE goal is 4% of the total dollar value of the job. (b) Bidders on this work will be required to comply with the President's Executive Orders Nos. 11246 (Equal Employment) as amended, 11518 (Small Business Concerns), and 11625 (MBE) as amended. The requirements for Bidders and Contractors under these orders are explained in the Specifications. (c) The goal for female utilization which shall be included in all federal and federally assisted construction contracts and subcontracts in excess of $10,000 shall be 6.9%. The goal for disadvantaged/minority utilization which shall be included in all federal and federally assisted construction contracts and subcontracts in excess of $10,000 shall be 1.2%. The goals are applicable to the Contractor's aggregate on-site construction workforce whether or not part of that workforce is performing work on a federal and federally assisted contract or subcontract. The low responsive bidder will be required to certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal. Please be advised that waivers and exemptions from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision does not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted. Payment for all work shall be in cash based on monthly estimates. Bids may not be withdrawn after the time fixed for opening them.
