The scope of work includes, but is not limited to, the removal of sludge within the existing basin and provide for an earthen levee, grading, and embarkment restoration that will divide the existing basin into two cells. In addition, the project will provide piping and valve modifications which will allow the City to operate each cell individually. Miscellaneous work may also include seeding, by-pass pumping, temporary containment, and hauling. Bid Security, only in the form of: 1) a certified or cashier's check drawn on a Texas bank and made payable to the City of Anahuac, Texas; or 2) a bond executed by a surety company authorized to do business in Texas, in the amount of not less than five (5%) percent of the total bid, must accompany each bid at the time it is submitted. Bids must be submitted in duplicate. Bids may be held by the City of Anahuac, Texas for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidder's qualifications prior to the contract award. Time for receiving bids is subject to change pending review and approval of the plans and specifications by the Texas Water Development Board This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. EPA rules require that prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of six affirmative step The right is reserved by the City of Anahuac, Texas, as its interest may require, to accept or reject any or all bids, and to waive any informality in the bids received The Work will be substantially completed within 80 working days after the date when the Contract Times commence to run and ready for final payment in accordance with Paragraph 14.07 ofthe General Conditions within 100 working days after the date when the Contract Times commence to run performance and payment bonds shall be in a penal sum of not less than 100 percent of the contract price and remain in effect for one year beyond the date of approval by the engineer of the subdivision.
