The Project consists of construction of the replacement of roof systems and related work at Neabsco Elementary School as shown on Contract Documents prepared by Facility Engineering Associates, P.C. (FEA), dated December 29, 2021. B. The Work generally consists of the replacement of approximately 43,800 square feet of existing roof with a modified bitumen membrane If the Bidder does not achieve the dates provided in Section 001010, Paragraph 1.2(c) as they may be adjusted under the Contract Documents, Bidder agrees that the damages suffered by the Owner for delay will be difficult to ascertain with any certainty, and agrees that the Owner may withhold the sum of One Thousand Five hundred dollars ($1,500.00) for each calendar day of delay beyond the agreed upon date for reaching Substantial Completion as liquidated damages and not as a penalty. This amount shall be collected per individual roof section or specific scope item that is not completed prior to the completion date listed in the Contract until such roof section or work item is deemed to meet the requirements of Substantial Completion. D. Once Substantial Completion has been awarded by the Architect, a time limit stipulated by the Architect and Owner will be allowed to the Contractor for the Contractor to complete the "punch list" and other close out requirements. Bidder agrees that the damages suffered by the Owner for delay in final completion will be difficult to ascertain with any certainty, but include possible disruption to school activities, extended contract administration costs and architectural fees. Accordingly, if Final Completion is not achieved within the allotted time, then the Owner shall be entitled to the sum of One Thousand dollars ($1,000.00) for each calendar day beyond the allotted time the work is not completed as liquidated damages and not as a penalty.
