Within ninety (90) days after bid opening, a contract will be awarded by the City to the lowest responsible bidder(s), subject to the right of the City to reject all bids or waive informalities or minor irregularities, as it may deem proper. By providing a Submission in response to this Solicitation, the Respondent represents and warrants that it has all licenses, permits, qualifications, and approvals required for the Respondent to furnish the Goods and/or Services required by the City. If the Respondent is an out-of-state entity, the Respondent represents and warranties that it possesses a valid certificate to transact business in the State of California issued by the California Secretary of State. City reserves the right to take any of the following actions in its absolute discretion:
1. The right to award in whole or in part.
2. The right to reject any and all bids is reserved by the City.
3. The right to increase or decrease the quantities listed.
4. The right to issue subsequent Invitation For Bids (IFB).
5. The right to approve or disapprove the use of particular subcontractors and/or suppliers.
6. The City reserves the right to waive any informalities or minor irregularities, as determined in its sole discretion,
in connection with bids received.
7. The right to make multiple awards to provide alternate sources to ensure continuity of services.
8. The right to accept a bidder's signed offer and issue a purchase order directly to the bidder based on the IFB.
