The work under this contract shall consist of excavation common, base aggregate dense, storm sewer, sanitary sewer, watermain, concrete curb and gutter, asphaltic pavement and all incidentals necessary to complete the work as shown in the plans and included in this contract. LIQUIDATED DAMAGES: Should the contractor fail to complete the work within the time set in the contract, or within such extra time as may have been allowed by extensions, there shall be deducted from any monies due or that may become due the contractor the sum of $1,000 for each and every day that the work remains incomplete. This sum shall be considered and treated not as a penalty but as fixed, agreed and liquidated damages due to the City of Wausau from the contractor by reason of inconvenience to the public, added costs of engineering and supervision, and other items which have caused an expenditure of public funds resulting from its failure to complete the work within the time specified in the contract. Where any deductions from or forfeitures of payment in connection with the work are duly and properly declared or imposed against the contractor in accordance with the terms of this contract, state laws, or ordinances of the City of Wausau, the total amount thereof may be withheld from any money whatsoever due or to become due the contractor under the contract and when deducted shall be deemed and taken as payment in such amount. If the amount of liquidated damages due to the City of Wausau exceeds the amounts due to the contractor, the contractor then shall be required to pay the excess to the City of Wausau.
