with such other works specified, or embraced, or included in the said Contract
Documents.The documents listed below are the Contract Documents which make up
the Contract between the Minister and the Contractor. The Ministry of Transportation requires operational services for the installation, removal and replacement of highway signs and various sign support systems on Provincial Highways throughout Central Region.
The Contractor shall install signs and various sign support systems, as well as remove, recover or dispose of same as directed by the Contract Administrator and according to the special provisions as indicated elsewhere in the tender.
Throughout the term of this RFT Contract, events may occur that may require the Ministry to
require the services of a Vendor to provide the work for the installation, removal and replacement of signs as described in this RFT Contract. As such, this RFT Contract is a request for Bidders to submit a price quotation for the work described herein.
The Ministry does not in any way guarantee the quantity of the work, either in whole or in part, that it may require in respect of this RFT Contract. At the RFT Closing Date and Time, if the Bidder Vendor meets the requirements of this RFT Contract, it will be placed on a list of eligible Vendors.
When the need for the work is required, as determined in the sole discretion of the Ministry, the Ministry will make an offer to a Bidder Vendor on the list with the most favorable prices contained in the RFT Contract for the work required so as to offer the Tender documents to the Bidder Vendor that will maximize the financial and operational requirements of the Ministry based upon the prices submitted by the Bidder Vendor.
If the Bidder Vendor fails to accept the offer from the Ministry for the work, the Ministry will contact
the next Bidder Vendor and so forth with the next favorable prices contained in the RFT Contract
until a Bidder Vendor accepts the Ministry's offer.
If any Bidder Vendor should refuse to accept the offer from the Ministry on three separate occasions, the Bidder Vendor shall be deemed to have relinquished its right to receive further offers for the work and the RFT Contract shall be considered terminated in respect of this Bidder Vendor, unless the Bidder Vendor satisfies the Ministry of the reason for failing to accept an offer.
In addition to the refusal to accept three offers without a satisfactory explanation, the Ministry may, in its sole discretion, refuse to make an offer to any Bidder Vendor who fails in its performance of the work on previous offers, including issues of lateness, defective work or poor quality of the work. In this situation, the Ministry may overlook such a Bidder Vendor and offer the work to another Bidder Vendor on the list in the same manner as previous described.
The Ministry reserves the right, in its sole discretion, to not make any offers to any Bidder Vendor on the list in respect of the work. The Ministry assumes no liability or responsibility, whatsoever, to any person as to the number and scope of the offers made in respect of the work. If necessary, the Ministry reserves the right, in its sole discretion, to engage and offer the work to more than one Bidder Vendor on the list
