ON-CALL WATER SYSTEM AND SEWER SYSTEM REPAIRS, FYE 2023-2025 (CIP 19-W004) The successful bidder shall provide on-call water system and sewer system repair services, commencing on the date in which the Notice to Proceed is issued, and ending on June 30, 2023 ("Base Term"). The Contract may be extended, at the District's option, for two (2) additional 12-month terms. The Contract, and subsequent options terms, will be issued on an annual basis, with no guaranteed minimum or maximum amount of work. All work will be procured on an "as-needed" basis. The District will evaluate each bidder's Section 00310 Bid Schedule with sample data from previous projects with known labor time and equipment costs. The District may select one (or more) successful bidders. Pursuant to the provisions of California Labor Code Section 6707, each Work Order Cost Estimate submitted in response to any Work Order Request associated with this Contract, shall contain, as a separate price line item, adequate sheeting, shoring, and bracing, or equivalent method, for the protection of life and limb in trenches and open excavation, which shall conform to applicable safety orders. By listing this sum, the bidder warrants that its action does not convey tort liability to the District and its employees, agents, and subconsultants. The successful bidder and its subcontractors shall employ workers, trades and craftsmen, which constantly display and demonstrate proper moral, ethical and professional conduct to all fellow workers, employees and representatives of the District and other involved entities. Each bid must conform and be responsive to the invitation, the Plans and Specifications, and all documents comprising the Contract Documents. By submitting a bid, the bidder agrees to execute the contract in conformity with the form of agreement contained within the contract documents, and will furnish bonds and insurance policies as specified within ten (10) days after notification of the award of the Contract. The contract documents that the successful bidder must submit within ten (10) days of notification of award include, but are not limited to, a payment or labor and materials bond in an amount of at least $350,000.00 and that satisfies the requirements of California Civil Code Section 3248, and a performance bond in an amount of at least $350,000.00. All project bonds must be executed by an admitted surety insurer in accordance with applicable law and acceptable to the District. Bidders shall develop and submit bids at their own expense. The District will not reimburse any costs associated with the development and submittal of any and all Bids. In accordance with California Public Contract Code Section 3400, the bidder may propose equals of products listed in the plans and specifications by manufacturer name, brand or model number, unless the technical specifications or plans specify that the product is only available from one source, or is necessary to match others in use. The District reserves the sole right to reject any or all bids and to waive any informality in a bid. No bidder may withdraw its bid for a period of sixty (60) calendar days after the date set for the opening thereof. The Bidder shall guarantee the total bid price for a period of sixty (60) calendar days from the date its bid is submitted. Any bid protest must be submitted in writing to the District Secretary before 5 p.m. of the fifth working day following bid opening as further described in 00100-21.0, BID PROTEST. The above time and content requirements are mandatory, and failure to comply therewith shall constitute a waiver of any further right to pursue a bid protest, including filing a Government Code claim or legal proceedings. Bid protests shall be acted upon by the District's Board. In accordance with the provisions of California Business and Professions Code Section 7028.15, a bid submitted to the District by a Contractor who is not licensed in accordance with Chapter 9 of the California Business and Professions Code shall be considered non-responsive and shall be rejected by the District. The Contractor shall not be qualified to submit a bid to perform the Work unless it is registered and qualified to perform public work pursuant to Labor Code Section 1725.5 at the time that the bid is submitted. Failure to have registered and thereby be qualified shall render the bid non-responsive.
