A timeline for award has not yet been established.** If the Contractor refuses, neglects, or fails to complete the Work within the time stated at each Phase in the Contract Schedule, then the Contractor and the Contractor's surety, if any, shall be liable for and shall pay the Owner, not as a penalty but as liquidated damages, the sum of five hundred dollars ($500.00) for each calendar day that the Contractor is in default after the time stipulated in the Contract Schedule (based on Schedule of Values provided by the contractor and signed and approved by the owner) for completing the Work of each Phase until the Work is Substantially Complete. The Owner may withhold from payments due the Contractor, such amounts as may be assessed as liquidated damages. Upon Substantial and Final Completion of the Work, the Owner may adjust the Contract Sum by the amount of the assessed liquidated damages.
