Following the submission of DBE documentation in compliance with EPA Regulations regarding initial solicitations, it is the intent of Capital Region Water to ensure nondiscrimination in the award and administration of contracts, to create a level playing field on which minority, women, veteran, service-disabled-veteran, and LGBT-owned business enterprises can compete fairly for Capital Region Water Contracts and subcontracts, to help remove barriers to the participation of minority, women, veteran, service-disabled veteran, and LGBT-owned business enterprises and to assist the development of firms that can compete successfully in the marketplace outside of this program. CRW will establish minimum participation levels (MPLs) for the MBEs, WBE, and other DBEs on a project-by-project basis. Contracts awarded under this invitation are funded through the Pennsylvania Infrastructure Investment Authority (PENNVEST), supported in part by Federal funding. This Project and the Work performed thereon is subject to federal prevailing wage rate laws (Davis Bacon Act). Notice is also given that this project is being federally funded by the EPA financial assistance dollars and therefore requires all contractors to demonstrate compliance with federal Executive Order 11625, 12138, and 12432 and EPA Regulations at 40 CFR Part 30, et al., through the detailed documentation of solicitation of Disadvantage Business Enterprises (DBEs). Contractors must demonstrate the Six Good Faith Efforts to identify and solicit DBE firms that are potential sources for any procurement action in the areas of project construction, equipment services, and supplies by including state qualified small businesses and minority and women owned business enterprises in the bidding process. DBE documentation must be submitted with the Bid. Bidders shall use the CRW form included in the Bidding Documents. A Bid Security in the amount of ten percent (10%) of the Bid shall accompany each Bid in accordance with the Instructions to Bidders. The Bidder to whom a Contract is awarded shall furnish a Performance Bond and a Payment Bond each in an amount equal to the Contract Price.Capital Region Water reserves the right to reject any and all Bids, to waive any defects, errors, and omissions, irregularities, or informalities in a Bid or the Bid procedure, and to accept any Bid deemed to be favorable to its interest.
