Persons or companies bidding on this project shall hold a current Utah Contractors License covering the type of work to be done and shall be bondable to the amount of the Contract. The Bid Bond in the amount not less than five percent (5%) of the above bid sum, shall become the property of the University of Utah as liquidated damages for delay and additional expense caused thereby in the event that the contract is not executed and/or acceptable 100% Performance and Payment Bonds are not delivered within the time set forth. Upon issuance of the Notice of Intent to the selected bidder (a letter to the Contractor issued by U Facilities) and the official Contract (Contractor's Agreement), the undersigned agrees to return the original signed Contract, and deliver acceptable Performance and Payment Bonds in the prescribed form in the amount of 100% of the Contract Sum for the faithful performance of the Contract, and deliver an acceptable Certificate of Insurance, all within ten (10) calendar days of the date on the Notice of Intent, unless a shorter time is specified in the Contract Documents. The University of Utah reserves the right to reject any or all bids or to waive any formality or technicality in any bid in the interest of the University.
