Demolition, site work, paving, new construction and addition to a mixed-use development in Huntsville, Alabama. Completed plans call for the addition of a laboratory facility; for the demolition of a laboratory facility; for the construction of a laboratory facility; military facility; for site work for a laboratory facility; warehouse / distribution facility; warehouse / distribution facility; water / sewer project; sidewalk / parking lot; and for paving for a sidewalk / parking lot.
1. Contracting Activity: U.S. Army Corps of Engineers (USACE), Mobile District (CESAM), Contracting Division 109 Saint Joseph Street, Mobile, AL 36602 2. Description of Action: This Justification and Approval (J&A) is requested to specify a make of a brand name specification in solicitation W9127822R0011, fiscal year (FY) 22 Propulsion Systems Lab (PN51899), Redstone Arsenal, AL. This solicitation is a Design-Bid-Build (DBB), firm fixed price (FFP) construction contract that will be funded by Army Military Construction (MILCON) funds. 3. Description of Supplies/Services: This justification is being prepared for the use of ARMAG Corporation for supply of a pre-fabricated Type 2 ammunition and explosives storage magazine engineered for two feet of earth cover. The Earth Covered Magazine (ECM) will be used as a Data Acquisition Building (DAQ) located within a primary detonation site. The design for the DAQ requires a Type 2 ECM 13.5' wide, 10' tall, and 31.5' long. The DAQ ECM must be manufactured to U.S. Military specification Naval Sea Warfare Center (NSWC) 3046-93-1, Department of Defense (DoD) 5100.76M, Army Regulation (AR) 190-11, and Office of the Chief of Naval Operations Instruction (OPNAVINST) 5530.13C. The DAQ ECM must also meet applicable requirements of DoD 6055.09-M, DoD Ammunition and Explosives Safety Standards and Department of Army Pamphlet 385-64, Ammunition and Explosives Safety Standards. The DAQ ECM design requires the following: a 4-ft exterior steel weather shield/porch extension, high security double doors with cam closer, lightning protection, interior explosion resistant lighting, quad receptacles, and a manufacturer's warranty period. 4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 United States Code (U.S.C) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), only one responsible source and no other supplies or services will satisfy agency requirements. 5. Reason for Authority Cited: As set forth in FAR 6.302-1(a)(2), when the supplies or services required by the agency are available from only one source, or for DoD, National Aeronautics and Space Administration (NASA), and the Coast Guard, from only one or a limited number of sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided. This authority is applicable to brand-name descriptions in accordance with FAR 6.302-1(c). Additionally, FAR 6.302-1(c)(ii)(A) & (B) state the J&A approval/threshold requirements are only applicable to the portion of the acquisition specific to the brand-name specification, and the J&A should indicate that the use of such descriptions in the CUI//SP-PROCURE//FED ONLY J&A Control #22-0004 CUI//SP-PROCURE//FED ONLY applicable portion of the acquisition is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. This brand name specification is essential to this procurement because only ARMAG Corporation's ECM can fully satisfy the Government's requirement; and competing the ammunition and explosives storage magazine portion of the MILCON procurement would result in significantly increased construction costs and significant schedule delays to the Government that are not expected to be recovered through competition. According to the Government's market research, ARMAG Corporation is only one vendor currently authorized by the U.S. Government to build to NSWC 3046-93-1 Government specifications. Based on the evaluation detailed below and in Section 8, the Government has determined that specifying ARMAG Corporation for meeting this requirement is in the best interest of the Government. a. Background: The Propulsion Systems Lab project includes modernization and expansion of multiple existing facilities and construction of multiple new stand-alone facilities to support Research, Development, Test and Evaluation (RDT&E) of propulsion systems and energetic propellants within Redstone Arsenal, Alabama. One of the facilities to be constructed is the DAQ ECM within the Snake Pit Detonation Range located within Test Area 10. The DAQ will be used for the purpose of storing and protecting sensitive data acquisition equipment used during intentional detonations. The ECM will be used as a DAQ located within a primary detonation site. The ECM will be earth-covered to reduce direct blast wave impacts improving the DAQ building protection and longevity. b. Justification: The end user of the Snake Pit Detonation Range has utilized the ARMAG Corporation ECM at other test areas at Redstone Arsenal with much success. This was taken into consideration during development of the FY22 Propulsion Systems Project, and for these reasons, ARMAG Corporation's ECM was referenced in programming resulting in a programmed cost reflective of an off-the-shelf pre-engineered solution. Research of this product line was conducted during project design. This research returned several vendors that can manufacture above ground Type 2 magazines; however, none of these vendors offer a prefabricated ECM like ARMAG Corporation, which are specifically engineered with the strength necessary to support two feet of earth cover. Custom designed and constructed in-place archstyle and box-type ECMs were also evaluated but were determined to be too costly and resulted in estimated project costs exceeding the project's budget. Pursuing a custom designed and constructed in place ECM is estimated to increase construction costs in the amount of $1M and between $3M and $5M for arch-style and box-type ECMs, respectively. Based on this research and the justification contained herein, it was determined that ARMAG Corporation is the only known source to provide a pre-fabricated Type 2 steel box ECM product engineered to be placed underground. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document.
