Pike Mountain Area Recreation Site Maintenance Contract for the period of April 1, 2022 to March 31, 2023 All inquiries should be made to Greg Hodson at Cascades District at 250-378-8400 or Greg.D.Hodson@gov.bc.ca The work will involve the cleaning, repairs and maintenance of facilities on Recreation Sites throughout the Pike Mountain Area as per attached Schedule A "Services". The Ministry, at their discretion, reserves the right to limit the number of contracts awarded to any one individual or corporation. Tenders must be submitted on the form and in an envelope labeled in accordance with the Conditions of Tender. No tender shall be considered that contains any qualifying clause whatsoever. The lowest of any tender will not necessarily be accepted. Recreation Site Name: Kump Lake - Robertson Lake - Stoney Lake - Lodwick Lake North - Lodwick Lake South - Goose Lake South - Thalia Lake South - Johnny Lake - Rickey Lake - Clifford Lake The Contractor will visit each site as per the schedule and frequency specified in Schedule C, for removal of garbage and sanitation of outhouses, minor facility repairs and paint structures as necessary. As well as those items listed in Schedule A "Services", periodically the Contractor may also be required to cut and clear fallen trees to open the roads into the campsites, and therefore the Contractor must be certified with WorkSafeBC to perform this activity. Major repairs to facilities shall be reported to the Ministry and may be carried out under an amendment to the contract. Program Information The Ministry of Forests, Lands and Natural Resource Operations and Rural Development, Recreation Sites and Trails Branch provides the public with opportunities for recreation experiences in provincial forests through the development and maintenance of recreational sites and trails for public use, usually at no cost. While no specific use figures are available for the recreation sites to be serviced under this contract, the level of use typically varies for each site, depending upon numerous factors including proximity to local communities, road conditions, weather, number of campsites, recreational opportunities at the site, type and quality of boat launch, etc. Generally speaking, the sites that have historically had higher use will have more frequent site visits scheduled in Schedule C. Work Excluded Pumping of pit toilets and the assessment and hand falling of hazardous (danger) trees at these recreation sites are services that may be provided by another contractor under a separate contract. If the successful bidder is certified and qualified to complete danger tree assessment and falling, these services may be added to this contract under an amendment to the contract. Site Conditions Due to their elevation, access to some recreation sites may be restricted by snowfall in the early and late parts of the recreation season. Due to an increased level of tree mortality from the mountain pine beetle epidemic throughout this region, it has become increasingly common for users to encounter downed trees across the access roads into recreation sites. This is particularly the case in the spring, and the Contractor should plan accordingly to spend more time and effort cutting and clearing the roads into the recreation sites during this period. Following heavy rainfall, the access to some recreation sites may be extremely muddy, and require the use a fourwheel drive vehicle. The Contractor shall use discretion at such times and shall not damage the road by attempting access by vehicle. The Ministry Representative may approve delayed servicing of the recreation site in such cases. Known Field Safety Hazards on this Contract Ministry staff and contractors, in the course of planning and developing this project, have identified the following known field safety hazards associated with this project. Note this list does not identify routine safety hazards associated with recreation site operations: o No "Known" safety hazards. Contractor Safety Program and Prime Contractor Responsibilities Bidders and the Successful Contractor must plan to maintain and implement a safety program as described under the Workers Compensation Act and its regulations. Province may from time to time give prior written notice that a person other than the Contractor is designated as the Prime Contractor. The Contractor agrees that on receiving such written notice, the Contractor will cooperate with the Prime Contractor and shall coordinate health and safety activities and ensure compliance with the Prime Contractor's safety program. The Contractor shall, upon becoming aware of any apparent deficiencies in the Prime Contractor's work which would affect the Work or Services, shall report such deficiencies in writing to the Ministry Representative. Bidders must be aware of the Safety Conditions Schedule attached to the contract agreement. A Ministry Representative may ask to examine the safety program and may ask for evidence to support the implementation of this safety program as part of the contract administration. Ministry Staff Do Not Direct Operations Ministry employees (Ministry Representatives) do not direct or supervise the contractor or the contractor's workers. The Ministry will set out the contract standards and required outcomes as well as any changes to contract conditions as work progresses. Obligation to Report Unsafe Conditions or Practices The Workers Compensation Act , Occupational Health and Safety Regulation 3.10 requires that any person (including Ministry of Forests, Lands and Natural Resource Operations staff) report any observed unsafe conditions or practices to the person in charge of the workplace. Ministry staff will do this in the course of their work on the contract area should they come across such conditions or practices. The anticipated term of the contract will be from April 1st , 2022 to March 31, 2023, however the "Service Period" or period in which services will be provided by the Contractor, will be from April 1st , 2022 to October 31 st , 2022. The successful Contractor shall be required to have a pre-work meeting with the Ministry Representative to review the contract prior to commencement of the work. Any subjects discussed and decisions made at the pre-work conference shall form an integral part of the contract. Option-to-renew A continuous service without further tendering is desired. Therefore, the contract being tendered contains an "option-to-renew" clause. Refer to the Conditions of Tender for further information. Contractor Invoicing An invoice must identify the contract it pertains to. The Province will pay any applicable taxes payable by it under law or agreement with the relevant taxation authorities. Invoices must show the calculation of any applicable taxes (excluding taxes paid directly by you to a supplier and which were inclusive in the bid price) to be paid as a separate line item for the Billing Period(s). Payment Policy Invoices and progress payments are not usually paid before 30 days from the date the Ministry receives the invoice, or the date the Ministry Representative authorizes payment, whichever is the latter. However, every effort is made to pay accounts between 30 to 40 days, maximum 60 days. The Financial Administration Act does not permit interest payments on progress payments, performance security deposits or holdbacks, until the 61st day after the date the money becomes due. The due date is calculated from the date the Ministry receives the invoice or the Ministry authorizes payment/release (whichever is the latter), to the date the Ministry of Finance prints the cheque. Interest rates are set by the Office of the Comptroller General. Interest claims of less than $5 are not payable. Direct Deposit In order to reduce mail time in the payment process, contractors may be registered with the Provincial Treasury. Payment will then be deposited directly to the contractor's bank account. Contact the finance section of the tendering office for information and/or application for registration. New applications require four to six weeks to process. Bidders' Dispute Resolution If a problem should occur during this tender call, it should be resolved informally with the Ministry Representative named in the invitation to tender. If the bidder is not satisfied with the outcome at this stage, or they prefer to bypass the informal route, they may engage the formal vendor complaint review process. Formal complaints concerning a competitive process or a pending or awarded contract, or other procurement process may be submitted by the bidder in writing at any time during the procurement process and up to thirty (30) business days after they have received notification from the ministry of the final outcome of the procurement process. Complaints in the formal process are submitted on the ministry approved Vendor Complaint Form. This ministry specific form is available to the general public through the Ministry of Labour, Citizen's Services and Open Government, Procurement Service Branch. Disputes occurring during the performance of the work/service will be governed by the dispute resolution terms and conditions of the Agreement. Lobbyist Registration Act It is the contractor's responsibility to abide by all applicable laws. If the contractor falls within the parameters of the Lobbyists Registration Act, then it is the contractor's responsibility to make this determination and register if necessary
