Arlington - Karns Fiber Optic Cable Installation Cut offf or questions at 4:00PM on February 8, 2022 Notice to Proceed March 7, 2022 Required Substantial Completion November 2, 2022 or 240 calendar days Bid security percent:5% CONTRACTOR and OWNER agree that as liquidated damages for delay (but not as a penalty), CONTRACTOR shall pay OWNER $1,000.00 for each calendar day that expires after time specified in paragraph 2 of this Agreement until the Work is Substantially Complete. After Substantial Completion, if CONTRACTOR shall neglect, refuse, or fail to complete the remaining Work in its entirety, CONTRACTOR shall pay OWNER $500.00 for each calendar day that expires after the time specified in paragraph 2 of this Agreement for completion and readiness for final Application for Payment in accordance with Section 01770 of the Specifications. The CONTRACTOR and OWNER recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by the OWNER if the Work is not completed on time. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree to the provisions herein.
