The scope of the project includes demolition, general construction, minor HVAC, and electrical work. All plans and specifications shall be returned to the Architect. All deposits shall be refunded in full if plans and specifications are returned in good condition to the Architect within ten (10) days after the proposal opening. No other form of security will be accepted. Failure to have a response physically in the possession of the Owner by the deadline shall result in the proposal not being considered. No electric or faxed responses will be accepted. The selection of the contractor shall be in accordance with Texas Government Code Chapter 2269, Subchapter C. The Owner reserves the right to waive any informalities or irregularities in connection to this proposal. The Owner reserves the right to reject any and all proposals and does not bind himself to accept the lowest proposal or any proposal for this work or any part thereof and shall have the right to ask for new proposals for the whole or parts, should he desire to do so. By submitting a proposal, the proposer fully and voluntarily agrees to waive any claim against Region 16 Education Service Center, and its Board Members, Officers, agents and or employees, the Architect/Engineer and their respective employees, arising out of or made in connection with the administration, evaluation or recommendation of any proposal. All proposals shall remain in effect for a period of sixty (60) days from the date of receipt unless sooner returned. Pursuant to the Texas Education Code, Region 16 ESC may consider the following in determining to whom to award this contract: 1. Price; 40%, 2. The offeror's experience and reputation, 20%, 3. The quality of the offeror's goods and services, 20% 4. The impact on the ability of the government entity to comply with rules relating to historically underutilized businesses, 5%, 5. The offeror's safety record,5%, 6. The offeror's proposed personnel, 4%, 7. Whether the offeror's financial capability is appropriate to size and scope of the project, 3%, 8. Any other relevant factor specifically listed in the proposal, 3%
