Mechanical Contract for construction of an Arena Air Conditioning project at the Joann Hetzel Memorial 4-H Building, located at 3715 East, Bismarck Expressway, Bismarck, North Dakota as described in the Contract Documents as prepared by Prairie Engineering, P.C., Bismarck, North Dakota, Engineer. General work will consist of incidental work associated with the installation of the HVAC system including, but not limited to, concrete equipment pads, bollards and new exterior wall penetrations. Mechanical work will consist of new rooftop units, supply and return air ductwork, and system controls. Electrical work will consist of incidental work associated with providing electrical power to the mechanical equipment. Each Bid must be accompanied by a separate envelope containing a Bidder's Bond in a sum equal to five percent of the full amount of the Bid, executed by the Bidder as Principal and by a Surety Company authorized to do business in this State, conditioned that if the Principal's Bid be accepted and the Contract awarded to the Principal, the Principal, within ten days after notice of award, will execute and effect a Contract in accordance with the terms of the Principal's Bid and a Contractor's Bond as required by law and the regulations and determinations of the governing board. All Bidders must be licensed for the highest amount of their Bids, as provided by Section 43-07-12 of the ND Century Code. No Bid will be read or considered which does not fully comply with the above provisions as to Bond and Licenses, and any deficient Bid submitted will be resealed and returned to the Bidder immediately. No Bidder may withdraw his Bid within 30 days after the actual opening of Bids. The Owner reserves the right to waive any informalities and to accept or reject any or all Bids. fully complete the project within 182 consecutive calendar days Contractorshall furnish a performance bond and a payment bond, each in an amount at least equal to the Contract Price The work covered by this Division consists in furnishing all labor, equipment, accessories and materials and in performing all operations necessary for the installation of the HVAC systems, in strict accordance with Division 23 of this Specification and applicable Drawings and subject to the terms and conditions of the Contract.
