As soon as the BID prices have been compared, the OWNER will return the BONDS of all except the three lowest responsible BIDDERS. When the Agreement is executed, the bonds of the two remaining unsuccessful BIDDERS will be returned. The BID BOND of the successful BIDDER will be retained until the payment and performance BONDS have been executed and approved. A certified check may be used in lieu of a BID BOND. The successful bidder must furnish 100% Performance and Payment Bonds and will be required to execute the Contract Agreement within 10 days following notification ofthe acceptance of his bid. The City expressly reserves the right to reject a bid from any Contractor who has within the last year, or is currently not, in substantial compliance, as determined by the City Manager, with the time requirements or other significant provisions of a City of Keene contract. This provision shall in no way be construed to prohibit the City Manager from rejecting any bid for other reasons. The City reserves the right to reject any or all Bids, waive technical or legal deficiencies, and accept any proposal that it deems in the best interest of the City
