The undersigned Bidder proposes to furnish and deliver castings, as itemized in the Bid Proposal. It is the responsibility of each Contractor submitting Bids for the work to assure himself/herself that the equipment/construction methods he/she intends to use are capable of complying with project specifications. The attention of each Contractor submitting Bid is directed to that portion of the project specifications which require the Contractor to demonstrate to the Engineer the ability of his/her crew(s) and equipment to comply with the specifications requirements and to do so at a rate of production consistent with the time allowed under the contract. The Contractor to whom the Contract is awarded shall be required to execute the Contract and furnish the insurance and bonds duly executed with a satisfactory surety company within five (5) days, excluding Saturdays, Sundays and legal holidays of the date of the mailing of the notice to the bidder according to the address given by him/her, that the Contract is ready for execution. The Contractor shall be required to start work within ten (10) business days of receipt of a notice to proceed and shall complete all work in a timely fashion as determined by the Commissioner of Public Services or his designee. Timely fashion shall be determined on a job specific basis by the Commissioner of Public Services or his designee. The Contractor shall furnish and deliver castings including catch basins and manholes. Manhole casting frames shall meet the following specifications: Heavy Duty Design Load (H-20) Coating - Unclipped Gray cast iron meets ASTM A48 CL35B Four (4) 1" Diameter Handling Holes Equally Spaced 90 Apart Note that the award and contract are subject to appropriation. Additionally, the written contract shall include the City's standard terms and conditions, with the possibility of amendments agreed to by the City. Attached hereto are the City's standard terms and conditions. Note further that the City will not agree to a contract that disclaims warranties, waives the City's right to a jury trial or any rights under the Uniform Commercial Code, requires payment of Contractor's attorneys' fees or interest, limits the City's damages, requires indemnification by the City or releases, limits or waives the City's rights and remedies under the law, among other things.
