Project Category Code: Waterlines, Directional Drilling Description: 3,819 L.F. 6"-10" PVC Watermain 150 L.F. 12" HDPE Watermain - Directional Drilled The extent of the work involved is furnishing all labor and materials for construction of the 2022 WATERMAIN IMPROVEMENTS together with related subsidiary and incidental work including: The project consists of: 3819 L.F. Watermain 150 L.F. Watermain HDD The method of construction shall be by Contract and all work is to be done in strict compliance with plans and specifications prepared by WHKS & Co., 2905 South Broadway, Rochester, Minnesota 55904 which have heretofore been approved by the City Council and are now on file for public examination in the office of the City Administrator. The parties hereby agree that damages occasioned the City by the Contractor's failure to complete the work within the Contract time, which shall also be defined to include the above stated intermediate Completion Dates, are difficult to measure. Therefore, if the Contractor does not complete all work under this Contract as required herein above, the Contractor shall pay to the City the sum of 1 thousand and no/100 dollars ($1000) per calendar day as agreed liquidated damages accrued by the City as a result of not having 100% use of the facilities and for administrative costs and professional services. Said payment of liquidated damages at daily rate stated above shall continue until all work is satisfactorily completed as specified and so determined by the Engineer. The City shall have the right to collect the above described liquidated damages by deducting said amounts from funds payable to the Contractor or by such other means as are available. In addition to the above liquidated damages for delay in performance, the City reserves all rights and remedies they may have against the Contractor for breach of Contract. Time is of the essence.
