**As of April 14, 2023, this project has been awarded to United Mechanical LLC in the amount of $954,910.00** For Lake Country Elementary School HVAC Renovation The Owner reserves the right to reject any or all bids received, accept bids in any order or combination, accept or reject portions of bids, and to waive all formalities in regard thereto. Bidding Documents include the Bid Process, Instructions to Bidders, the Bid Form, other sample bidding and contract forms and the proposed Contract Documents including any Addenda issued prior to receipt of Bids. The Contract Documents for the equipment purchase and installation consist of the Conditions of the Contract (General, Supplementary and Special Conditions), the specifications and all addenda issued prior to and all modifications issued after execution of the contract. All Definitions set forth in the General Conditions of the Contract for Construction or in other Contract Documents are applicable to the Bidding Documents. Addenda are written or graphic instruments issued by the Engineer prior to the execution of the Contract that modify or interpret the Bidding Documents by additions, deletions, clarifications or corrections. A Bid is a complete and properly executed proposal to perform the equipment purchase and installation or designated portion thereof for the sum stipulated therein, submitted in accordance with the bidding documents. The Base Bid is the sum stated in the Bid for which the Bidder offers to perform the Work described in the Bidding Documents as the base, to which work may be added or from which work may be deleted for sums stated in Alternate Bids. An Alternate Bid (or Alternate) is an amount stated in the Bid to be added to or deducted from the amount of the Base Bid if the corresponding change in the equipment purchase and installation, as described in the Bidding Documents, is accepted. A Unit Price is an amount stated in the Bid as a price per unit of measurement for materials, equipment or services or a portion of the equipment purchase and installation as described in the Bidding Documents. A Bidder is a person or entity who submits a bid. A Sub-bidder is a person or entity who submits a bid to a bidder for materials or labor for a portion of the equipment purchase and installation. Performance and Payment Bond(s): The successful bidder shall be required to furnish a Performance and Payment Bond(s) in the amount of one hundred percent (100%) of the contract amount. The bond shall be a surety insurer authorized to do business in the state of Florida and shall be set forth in 255.05, Florida Statues. Contractor may utilize the enclosed forms. All required premiums shall be paid by the successful bidder and the amount of the premiums shall be included in his Bid Proposal. Manufacturer's Representative shall be construed to mean Architect's Representative. The Owner shall have the right to reject any or all bids and in particular, to reject a bid not accompanied by any data required by the bidding documents, or to reject a bid, which is in any way incomplete and irregular. The SBHC reserves the right to reject any and all bid proposals or any part of any and all bid proposals and to waive minor irregularities or mistakes or to contract as deemed in the best interest of the School Board of Highlands County, Fl. The SBHC specifically reserves the right to reject any or all proposals or any part of any proposal or any conditional proposal. Any special conditions (conditional proposal) the contractor desires to be considered by the SBHC and to be made a part of their proposal must be submitted in writing on the bid proposal form and must be initialed by the person authorized to sign the proposal . Rejection of Warranties: The Owner reserves the right to reject warranties and to limit selections to products with warranties not in conflict with requirements of the Contract Documents. Refer to bid form for liquidated damage provisions. ailure to deliver substantial completion of the project within the time fixed in this Agreement will result in substantial injury to the Owner, and as damages arising from such failure cannot be calculated with any degree of certainty, it is hereby agreed that if substantial or final completion is not delivered with the time fixed or within such further time, if any, as may be authorized in accordance with the Contract Documents, the contractor shall pay to the Owner as liquidated damages for such delay, and not as a penalty, one thousand ($1,000) for each and every calendar day after time fixed within this document. Liquidated damages shall be payable in addition to any additional expenses or costs payable by the manufacturer's representative to the Owner under the provisions of the Contract Documents and shall not exclude the recovery of damages by the Owner under the Contract Documents This provision of liquidated damages for the delay shall in no manner affect the Owner's right to terminate the Contract. The Owner's exercise of the right to terminate shall not release the Contractor from his obligation to pay liquidated damages. It is further agreed that the Owner may deduct from the balance of the Contract Sum held by the Owner the liquidated damages stipulated herein or such portions as said balance will cover.
