Konocti Unified School District ("KUSD") is seeking one or more qualified construction management firms to provide preconstruction and construction management services in connection with upcoming construction projects and remaining Measure "Y" Bond Projects throughout KUSD (hereinafter referred to collectively as "Projects") and any additional projects that KUSD may later identify. The construction management services will include but not necessarily be limited to the following numbered items and the services described in the attached Agreement for Construction Management Services: Construction Management Services: 1. General: a. Understand and represent KUSD's goals and objectives for the project; b. Coordinate project activities with and assist KUSD's Project Inspector; c. Coordinate project activities with KUSD's Architect and consultants; d. Make recommendations, if appropriate, which may be incorporated into plans and specifications for project; Bidding Phase: a. Coordinate prequalification if applicable; b. Participate in bid conferences and advise KUSD, as needed; c. Review bids, schedule, and materials breakdowns submitted by bidders; 3. Construction Phase: a. Attend site meetings at least weekly and prepare complete and accurate meeting minutes for such meetings for distribution; b. Attend monthly Board meetings and other KUSD meetings as required; c. Advise and assist KUSD to develop economic, efficient, and desirable design, development and construction procedures; d. Review and advise KUSD concerning submittals, product samples, and specifications provided to Architect by contractor, subcontractors, and material suppliers for the project; e. Analyze recommendations from Contractor, Architect, or other consultants which could improve the project or decrease construction time or costs; f. Track all preliminary lien notices related to the project; g. Track all necessary conditional and unconditional liens, and keep the KUSD informed of the status of lien releases; h. Review all change order requests issued by contractors and advise KUSD about the form and content of such change orders in relation to the plans, specifications, and the contract documents; i. Review and make recommendations on all payment requests pursuant to the contract documents, architect agreement, or other consultant agreements related to the project; j. Identify possible payment defaults on part of contractors, subcontractors, material suppliers, or any party who may have lien rights against the project; k. Perform periodic inspections of project at least once a week, or as often as necessary to verify: 1) materials and labor being furnished are according to plans and specifications; 2) work billed for each payment requested is completed in accordance with the plans and specifications; 3) contractor time schedule is being maintained, as required by construction contract documents; and 4) costs are within the KUSD's budget; l. Provide monthly accounting and Project Status Reports; Close-Out Activities: a. Assist Architect in the preparation of punch lists for contractor, subcontractors, and other consultants on the project, coordinate and assist Architect in scheduling the completion of all such corrective work, and participate in all inspections; b. Assist Architect in coordinating and assembling all warranties and guarantees as required by construction contract documents from the Contractor and submit to KUSD. c. Coordinate with Architect, DSA, OPSC, and Department of Education for final acceptance of Project; d. Advise the KUSD on project closeout and final hard and soft costs; 5. Additional Services: a. Develop, assemble, and submit documentation required to support the KUSD's position in the resolution of Contractor's claims, if necessary; b. Other activities as requested by KUSD. It is the desire of KUSD to select one or more Construction Manager/Firm that can meet or exceed KUSD's requirement to provide the highest quality management, coordination, oversight and technical construction expertise at reasonable costs. Background The Konocti Unified School District (KUSD) serves approximately 3,000 students in four (4) elementary schools, one (1) 2-12 performing arts school, one (1) 3-8 continuation school, one (1) continuation high school, and one (1) comprehensive high school. KUSD's district boundaries are within the City of Clearlake, the County of Clearlake Oaks and Lower Lake and is located in Lake County, California III REQUIREMENTS FOR SUBMITTAL Each proposed construction management firm is required to submit the following: Description of the Firm and its team members and the legal entity the Firm operates under, the Firm's organizational and management approach, and the role of each team member and major consultants. List of K-12 school projects the Firm has participated in within the last 5 years and the role played in the project (e.g. design, construction, consulting, etc.) Identify the project name and location, size and date constructed. Include a list of the total change orders for each of the representative projects. Proposed consultants and technical assistants and corresponding billable rates. Discussion of constructability review and value engineering analysis of construction documents. Please fully describe the efforts that will be utilized to undertake constructability review and value engineering in order to minimize KUSD's exposure. Copy of constructability review performed and prepared for another school district. Discussion of how a budget will be established for the Projects and any savings that may be obtained through value engineering. Discuss the manpower requirements of the construction management team and experience of the onsite support needed. Discuss the Firm's ability to meet construction schedules for the projects with very tight timetables, Firm's schedule management procedures, and how the Firm has successfully handled potential delays both for the contract documents and for field changes. If applicable, provide a statement of any recent, current or anticipated contractual obligations that relate in any way to similar work, the Project, or KUSD that may have a potential to conflict with Firm's ability to provide the Services described herein to KUSD. Firms cannot submit, propose, bid, contract, sub-contract, consult, or have any other economic interests in the Project to which the Firm may provide Services. Specify the current and projected workload of Firm and describe Firm's ability to complete the Services as required herein. Provide a statement of ALL claim(s) filed against Firm in the past five (5) years. Briefly indicate the nature of the claim and the resolution, if any, of the claim(s). The following must be submitted on a separate attachment: a. List of proposed personnel. b. Proposed fees for the Projects if using a method other than the Office of Public School Construction ("OPSC") guidelines. The final construction management fees for the Projects will be negotiated. c. Proposed typical general conditions and a breakdown of general conditions costs for the Projects. d. Any additional services that are anticipated, but not covered in this RFP. e. Description of preconstruction services provided by your firm and costs for such services. General Information 1. Submittals should be brief and concise, but provide sufficient clarity to meet the criteria to be used in the evaluation process. Any Proposals received at the designated location after the scheduled time may be returned an ineligible for award. KUSD's records of receipt are presumed determinative relating to when the Proposals are received. 3. Any questions regarding this Request for Proposal shall be directed to the following individual(s) via email: becky.salato@konoctius.org or stephanie.hunt@konoctiusd.org Contact with any other KUSD personnel other that those listed above or contact in any manner with any Board member shall be grounds for the disqualification of the firm submitting a Proposal. 4. Interviews are scheduled for the afternoon of March 15th, 2022. Firms will be given their interview time when turning in their proposals. Interviews will be limited to approximately 20-30 minutes per firm. Firms should give a very brief (under five minutes) overview of their organization and then be prepared to answer questions asked by KUSD staff. The KUSD interview committee will consist of approximately seven staff members and the interview may take place virtually or in person. IV DISTRICT REQUIREMENTS It is the KUSD's intent to develop a pool of qualified firms to provide preconstruction and construction management services for the Projects. As Projects are scheduled to be implemented, KUSD will assign Projects to qualified firms. The assignment of firms to specific Projects is at the sole discretion of KUSD. While it is the KUSD's desire to use all firms in the qualified pool developed by the KUSD, firms are not guaranteed any minimum amount of work and may not be assigned to any future Projects if deemed in the best interest of KUSD. The firm selected for a specific Project will be required to enter into a contractual agreement with KUSD with incorporates various terms and conditions and a scope of work regularly utilized by KUSD for school facility projects (see sample agreement attached for multi-prime projects Appendix A). The proposed contractual agreement will comply with all applicable law and regulations. This Request for Proposal does not commit KUSD to award a contractual agreement with any firm or to pay any costs incurred in the preparation of Proposals. KUSD reserves the right at its sole discretion to accept or reject any and all Proposals received as a result of this RFP and to waive any informalities or irregularities in any Proposal or the RFP process. V SELECTION & EVALUATION CRITERIA The following criteria will be adhered to in evaluating each construction management firm's Proposal: 1. Discussion of the legal entity that identifies the construction management team, including but not limited to, proper licensure. 2. Demonstration of creative and cost-effective performance that meets the needs of KUSD utilizing quality building materials and construction procedures. 3. Demonstrated evidence that the construction management firm has the financial capability to obtain and maintain the necessary bonds and insurance to cover its construction management services. 4. Successful experience in managing school construction projects. 5. Satisfactory reference from school districts. 6. Ability to perform constructability reviews. 7. Ability to perform cost estimating utilizing the format approved by OPSC. 8. Demonstrated ability to perform value engineering. 9. Expertise in reviewing major building systems for the Projects. 10. Discussion of how Construction Manager will identify procedures and processes to team with an architect on the Projects. The Method of Contractor Selection has not been determined at this time.
