This RFP is a part of the process for the District's selection and retention of a HVAC maintenance/repair services firm to provide routine scheduled maintenance and on-call as- needed repair services for District HVAC equipment. Scheduled/routine maintenance is referred to herein as Maintenance and as needed repair services are referred to herein as Repairs. Timely submitted RFP Responses will be evaluated to ascertain the Respondents' respective qualifications, based on the criteria established in this RFP. Following the determination of which Respondents meet or exceed the qualifications standards set forth in this RFP, the District will evaluate pricing proposals submitted by the qualified firms. RFP Responses shall be submitted to the following location at or prior to the latest date/time set forth herein for submittal of RFP Responses. Compton Community College District Campus Police Building 1111 East Artesia Boulevard Compton, California 90221 Attn: Reuben James The District anticipates the following activities relating to the RFP will be completed at the times noted below. The foregoing notwithstanding, the District reserves the right to modify RFP activities and/or the time for completion of an RFP activity. The District expressly reserves the right to modify any portion of this RFP prior to the latest date/time for submission of RFP Responses, including without limitation, the cancellation of this RFP. 1.5RFP Addenda. Modifications, if any, to the RFP will be in writing and in the form of Addenda to the RFP. Addenda issued by the District will not be distributed to Respondents. Addenda will only be posted to the District's website (link above). Respondents are responsible for regularly reviewing the District's website for Addenda to this RFP. Respondents must acknowledge receipt of all Addenda issued by the District in their respective RFP Responses. Failure of a Respondent to acknowledge receipt of all Addenda issued by the District will result in rejection of a RFP-CCC-067 Response for non-responsiveness. 1.5.3. No Oral Clarifications/Modifications. The District will not provide any oral clarifications or modifications to the RFP or the requirements hereof; no employee, officer, agent or representative of the District is authorized to provide oral clarifications or modifications to the RFP. No Respondent shall rely on any oral clarification or modification to the RFP. Except for materials deemed Trade Secrets (as defined in California Civil Code 3426.1) and materials specifically marked "Confidential" or "Proprietary", all materials submitted in response to this RFP, except Financial Statements, are public records. The foregoing notwithstanding, the District may reject for non-responsiveness the RFP Response of a Respondent who indiscriminately notes that its RFP Response or portions thereof are "Trade Secret" "Confidential" or "Proprietary" and exempt from disclosure as a public record. In accordance with applicable law, materials submitted in response to this RFP are deemed public records after completion of the interview process by the Selection Committee. The District is not liable or responsible for the disclosure of RFP Responses, or portions thereof, deemed to be public records, including those exempt from disclosure if disclosure is by law, by an order of Court, or which occurs through inadvertence, mistake or negligence on the part of the District or its agents or representatives. If the District is required to defend or otherwise respond to any action or proceeding wherein request is made for the disclosure of the contents of any portion of a RFP Response deemed exempt from disclosure hereunder, by submitting a response to this RFP, each Respondent agrees to defend, indemnify and hold harmless the District in any action or proceeding from and against any liability, including without limitation attorneys' fees arising therefrom. The party submitting materials sought by any other party shall be solely responsible for the cost and defense in any action or proceeding seeking to compel disclosure of such materials; the District's sole involvement in any such action shall be that of a stakeholder, retaining the requested materials until otherwise ordered by a court of competent jurisdiction. Pursuant to California Labor Code 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the Work is to be performed. Copies of these determinations, entitled "PREVAILING WAGE SCALE" are available for review on the internet at http://www.dir.ca.gov/dlsr/statistics_research.html. The Contractor awarded the Contract for the Work shall post a copy of all applicable prevailing wage rates for the Work at conspicuous locations at the Site of the Work. The Contractor and all Subcontractors performing any portion of the Work shall pay not less than the applicable prevailing wage rate for the classification of labor provide by their respective workers in prosecution and execution of the Work. During the Work and pursuant to Labor Code 1771.4(a)(4), the Department of Industrial Relations shall monitor compliance with prevailing wage rate requirements and enforce the Contractor's prevailing wage rate obligations. Bidders must possess the following classification(s) of California Contractors License at the time that the Bid Proposal is submitted and at time the Contract for the Work is awarded: C-20 Warm-Air Heating, Ventilating and Air-Conditioning. The Bid Proposal of a Bidder who does not possess a valid and in good standing Contractors' License in the classification(s) set forth above will be rejected for non-responsiveness. Any Bidder not duly and properly licensed is subject to all penalties imposed by law. No payment shall be made for the Work unless and until the Registrar of Contractors verifies to the District that the Bidder awarded the Contract is properly and duly licensed for the Work. Bidder and Subcontractors DIR Registered Contractor Status. Pursuant to and in accordance with Labor Code 1771.1, each Bidder must be a DIR Registered Contractor when submitting a Bid Proposal. The Bid Proposal of a Bidder who is not a DIR Registered Contractor when the Bid Proposal is submitted will be rejected for non-responsiveness. All Subcontractors identified in a Bidder's Subcontractors' List must be DIR Registered contractors at the time the Bid Proposal is submitted. All costs and expenses incurred by a Respondent to prepare and submit a response to this RFP and all other activities related to this RFP shall be borne solely and exclusively by the Respondent. The method of contractor selection has not been determined at this time.
