The Town of Foxborough, Massachusetts, the Awarding Authority, invites sealed bids for the West Street Dam Spillway Removal, Culvert and Water Main Replacement, Town of Foxborough, Massachusetts in accordance with the documents prepared by Environmental Partners Group, LLC. The Work under this Contract includes, but is not necessarily limited to, repairing the existing West Street Dam structure and replacing the existing spillway, replacing the retaining wall on the downstream embankment of the dam, replacing the existing cast iron water main on West Street from South Street to Konet Road with ductile iron water main, and widening a portion of West Street. The project shall include furnishing all labor, services, equipment, materials, devices, facilities, and appurtenances for the installation of new materials, equipment, and facilities required including; stream bypass and dewatering; demolition; erosion controls; clearing and grubbing; site grading; surface restoration; wetland replication; precast concrete box culvert, headwalls, and wing walls; water main, hydrants, valves, services, and appurtenances; gravity retaining wall; roadway widening, sidewalk, and guardrail; stormwater controls; and furnishing and installing all proposed items and necessary incidental appurtenances to complete the work. Construction must be complete 260 calendar days from and including issuance of a notice to proceed, and/or receipt of fully executed contract. No Bidder may withdraw his/her Bid for a period of thirty (30) calendar days after the actual date of the opening of the Bids. The bidding and award of the Contract shall be in full compliance with Sections 39M inclusive of Chapter 30 of the General Laws of the Commonwealth of Massachusetts as last revised. This project shall also comply with Sections 39F, 39K, 39N, and 39O of Chapter 30 of the General Laws of the Commonwealth of Massachusetts as last revised and included in Appendix B of the Contract Documents. Each bid shall also be accompanied by a bid security in the form of a certified, treasurer's or cashier's check, bid bond or cash in the amount of 5 percent (5%) of the value of the Bid. Minimum wage rates as determined by the Commissioner of Department of Workforce Development under the provision of the Massachusetts General Laws, Chapter 149, Sections 26 to 27G, as amended apply to this project, as contained in Appendix A of the Contract Documents. It is the responsibility of the contractor, before bid opening, to request, if necessary, any additional information on the Minimum Wage Rates for those trade people who may be employed for the proposed work under this Contract. The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be the best interest of the Town of Foxborough. The Owner reserves the right to omit part or whole of any proposed work to be performed, as described in the Contract Documents, as may be required to maintain the total cost of work within available funds.
