Various works are also part of the mandate. Only contractors having an establishment in Quebec or, when an intergovernmental agreement is applicable, in a province covered by this agreement, and holding, where applicable, an appropriate construction contractor's license issued by the Régie des Quebec construction companies. Specific directives according to the regulation relating to the contractual management policy of the MRC du Haut-Richelieu: Any person who communicates or attempts to communicate, for the purpose of influencing him, with one of the members of the selection committee regarding a call for tenders for which he, or a person he represents, has submitted a tender, will be able to see this submission rejected. The MRC du Haut-Richelieu may terminate or amend a contract obtained by a company that has communicated or attempted to communicate, with the aim of influencing it, with one of the members of the selection committee in relation to this call for tenders. The MRC du Haut-Richelieu, in the event of non-compliance with the Lobbying Transparency and Ethics Act (RSQ, c. T-11.011) and the Lobbyists' Code of Ethics, may terminate the contract if the non-compliance is discovered after the contract has been awarded, provided that the breach is linked to events directly related to a contract or a call for tenders from the MRC du Haut-Richelieu. In the event that the bids are higher than the market rates, the MRC du Haut-Richelieu reserves the right not to retain any bid. Any donation, payment, offer, remuneration or advantage granted to an employee, member of the selection committee, member of the council of the MRC or to the person designated under article 5 A.1 of the contract management regulations of the MRC du Haut-Richelieu with a view to being awarded a contract, may lead, by decision of the council, to the rejection of the tender or, where applicable, the termination of the contract. A person who participated in the preparation and follow-up of the call for tenders may not bid, nor directly or indirectly control a bidding company. REQUIREMENTS To be considered eligible, any submission must be accompanied by: a bid bond or a certified check equivalent to 10% of the amount of the bid in favor of the MRC du Haut-Richelieu and valid for a period of sixty (60) days following the opening of the bids; a letter of intent from a company authorized to stand surety and undertaking to provide a performance bond equivalent to 50% of the amount of the contract, as well as a guarantee of payment of wages, materials and labor equivalent to 50% of the contract amount. Tenderers may attend the opening of tenders. Only the complete tender form as well as the "Tenderer's Declaration" (4 pages) in accordance with the contract management regulations will be accepted. The MRC du Haut-Richelieu does not undertake to accept the lowest or any of the tenders received and opened, and it will not take into account tenders that do not comply with the estimate or the tender form.
