Reference number : 1581711 Review Title : Development of structure and pavement laboratories Deadline for receipt of complaints: 2022-03-22 Submission sent electronically accepted: Yes, in a single submission document The École de technologie supérieure (hereinafter Owner), is requesting Tenders for the development of a structural laboratory and a pavement laboratory in Pavilion A located at 1100 rue Notre-Dame O. in Montreal ( hereinafter Project). The Owner implements state-of-the-art laboratories on its campus to prepare and carry out experimental research activities on materials and large-scale structural elements. Testing and research activities will notably take place in closed laboratory spaces, where temperature and humidity will be controlled. They concern in particular the study of materials, roads and structures. The laboratories are intended for the preparation and performance of various tests on structural components of buildings and/or large-scale bridges. This call for tenders refers to two (2) scenarios. The Bidder may submit a price for each of the scenarios or for a single scenario. Here are the scenarios: Project development including the construction of a climatic chamber; (the Owner prefers this scenario if the budget allows it) Development of the Project excluding the construction of a climatic chamber; The Owner will choose, according to budgetary considerations, the scenario he wishes to carry out. The contract will be awarded to the lowest compliant Bidder of the chosen scenario. Timeline The planned timeline for the Project is as follows: Contract Award: Mid-April 2022 Contract signature : End of April 2022 Mobilization of the Contractor: Early May 2022 Beginning of the roadworks : Early May 2022 Provisional acceptance: End of December 2022 Correction of deficiencies: Mid-January 2023 Final acceptance : February 2023 The Owner reserves the right to terminate the Contract if the Contractor fails to meet the schedule. The Owner reserves the right to modify the schedule proposed above without notice or penalty and without incurring additional costs. The information session and the visit are at the expense of each Bidder. They will allow the Bidders to read the requirements of the Contract and to obtain all useful information, as well as to check all the conditions that may affect their Bid. Failure to participate in the information session and the visit cannot be used as an excuse or pretext for errors, omissions or irregularities on the part of a Bidder. Each Bidder is responsible for delegating a representative. A bidder who does not attend the information session and visit understands and assumes that he will not have the information that could be given during these. Throughout the visit, wearing a mask and maintaining a distance of two (2) meters will be compulsory . Bid guarantee The Bidder must provide with its Bid a bid security corresponding to ten percent (10%) of the value of scenario 1 or scenario 2 of the Bid. The bid security is made in the form of a bond issued by a Financial Institution and must comply with the requirements of Schedule 1 of the Regulation respecting construction contracts of public bodies , money order or certified check payable to the order from the School of Higher Technology. The tender guarantee must be valid for a period of forty-five (45) days from the deadline for receipt of tenders. Guarantee of performance and guarantee of the contractor's obligations for wages, materials and services The performance guarantee and the guarantee of the contractors obligations for wages, materials and services in the amount each corresponding to fifty percent (50%) of the price indicated in the Contract, are in the form of a bond issued by a Financial Institution and must comply with the requirements of Schedules 2 and 3 of the Regulation respecting construction contracts of public bodies . The performance guarantee and the guarantee of the contractor's obligations for wages, materials and services will remain in force for the duration of the Contract. If applicable, the Contractor must provide proof of the renewal of these warranties before their expiry for the entire duration of the Contract. Intergovernmental agreements The following Agreements apply to this tender: Canadian Free Trade Agreement Quebec and New Brunswick Public Procurement Liberalization Agreement Trade and cooperation agreement between Quebec and Ontario Tender documents The Tender Documents are only available via the electronic tendering system . No verbal information is binding on the Owner and may be construed as modifying the Tender Documents. Eligibility requirements The failure of a Bidder to meet any of the eligibility conditions described in this call for tenders renders him ineligible for the presentation of a Bid. To this end, the Bidder: and its employees must have the necessary qualifications, authorizations, permits, licenses, registrations, certificates, accreditations and certifications; More specifically and without limiting the generality of the foregoing, the Bidder: must hold a general contractor's license adequate to carry out the work in accordance with the Building Act, CQLR c B-1.1; must employ a superintendent assigned to the Project who must have a minimum of ten (10) years' experience in the field of earth support or post-tensioning installation in a building in operation; must have carried out at least three (3) projects with a minimum value of $ 500,000 for earth support or post-tensioning installation in a building in operation, during the last ten (10) years; must have requested, completed and signed the Tender Documents in its name only, as indicated in article 1.11; must hold the Attestation de Revenu Québec, as described in article 1.15; and its directors must not have performed one or more acts described in the Bidder's Probity Attestation Form (Appendix B). The Bidder must sign a declaration to this effect, as specified in Article 1.16; must provide a letter of commitment, issued by a Financial Institution, stating that if the Contract is awarded and accepted it will issue a performance bond and a contractor's obligations bond for wages, materials and services as defined in section 1.21; must hold the insurance cover specified in article 2.4 or provide a letter of undertaking issued by an insurance company stating that if the Contract is granted and accepted, it will issue insurance cover in accordance with the description provided in section 2.4; must have in Quebec or in a territory covered by an applicable intergovernmental agreement, an establishment where he carries out his activities on a permanent basis, clearly identified in his name and accessible during normal office hours; must not be registered in the register of enterprises ineligible for public contracts (RENA) or, if it is registered there, that its period of ineligibility for public contracts has ended, as detailed in article 1.12; must be a legal person governed by private law, a general, limited or joint-venture partnership or a sole proprietorship; must hold the authorization to contract with a public body prior to obtaining a public contract issued by the Autorité des marchés publics (AMP), as detailed in article 1.17, if the amount of the Bid l 'required; must satisfy any other eligibility condition set out in the Tender Documents. CONDITIONS OF COMPLIANCE Any Submission with one of the following non-conformities will be deemed non-compliant and will be automatically rejected: Non-compliance with the deadline date and time set for the receipt of Submissions; Form 1 was not used to submit the Bid, as required in Section 1.10; the price submitted was not indicated on Form 1, as required in article 1.10; the Form 1 has not been signed by an authorized person, as required in section 1.10; a deletion or correction made to the price submitted and not initialed; a conditional or restrictive Bid; the fact that the Submission transmitted electronically was not transmitted through the electronic tender system or the fact that it is unintelligible, infected or otherwise unreadable once its integrity has been established by the electronic tender system ; the Bid that includes an abnormally low price within the meaning of the Regulation respecting construction contracts of public bodies ; if the Bidder submits more than one Bid for this call for tenders, all Bids submitted by the Bidder will be automatically rejected. For the purposes of this paragraph, the transmission of the same Submission electronically and in paper form is deemed to be the filing of several Submissions; presentation of a guarantee that does not comply with the required form and conditions; non-compliance with any other compliance condition indicated in the Tender Documents as resulting in the automatic rejection of a Tender. In addition, a Submission transmitted on paper containing one of the following non-conformities will be deemed non-compliant and will be automatically rejected: Failure to respect the place provided for the receipt of Bids; Form 1 was not returned in the Bid envelope; the Submission was not presented in an opaque and sealed envelope, as required in article 1.10; Any omission or error other than those referred to in the preceding paragraphs with respect to a Submission will not necessarily result in the rejection of the Submission. The Owner may allow the Bidder to correct it within a time period that it will determine. The correction made must be to the satisfaction of the Owner and cannot lead to an increase in the price submitted. In the case of a Bid transmitted electronically whose integrity has not been established, the Bidder must remedy this irregularity within 2 working days following the notice of default sent by the Owner. Failure of the Bidder to perform within the time limit will result in the rejection of the Bid. A Submission transmitted electronically within the time limit set to remedy the lack of integrity of a Submission transmitted previously replaces the latter as soon as its integrity is noted by the Owner. This Submission is then deemed to have been transmitted before the deadline date and time set for the receipt of Submissions. Unsatisfactory Performance Rating The Owner reserves the right to refuse any Bidder who, during the two (2) years preceding the opening date of the Bids, has been the subject of an unsatisfactory performance evaluation by the Owner, has failed to respond to a tender or a contract or has been the subject of a contract termination due to its failure to comply with its conditions. Full submission per scenario for single award This call for tenders refers to two (2) scenarios. A single contract will be awarded according to the scenario chosen by the Bidder. It is strongly suggested that the Bidder submit a bid including a price for each of the scenarios. The Owner does not undertake to accept either the lowest or any of the Tenders received, nor to carry out the object of this call for tenders, nor to carry out only a part thereof and may, at its sole discretion, not carry out anything in link with this invitation to tender and this, without any compensation for the Bidders. Please note : In this document, any term referred to in the masculine also includes the feminine and vice versa. Similarly, any term mentioned in the singular includes the plural and vice versa.
