Middlesex College is a public tax supported institution in the State of New Jersey, and the County of Middlesex. As such, the College has the desire, requirement, and responsibility to adhere to all the applicable statutes, policies, practices, and individual judgments which protect or advance the interests of the citizenry. Consultants, therefore, must agree, if applicable, to execute and provide all affidavits, agreements, certificates, statements, authorizations, and other assurances or documents of compliance which Middlesex College may require in such cases as Equal Employment Opportunities, Non-Collusion, Board of Trustees Letter, Consent of Surety, Stockholder Disclosure, and other forms required by law and the Board of Trustees. The Consultant shall not assign the whole or any part of this contract or any moneys due or to become due hereunder without written consent of the College. In case the Consultant assigns all or any part of any moneys due or to become due under this contract, the instrument of assignment shall contain a clause substantially to the effect that it is agreed that the right of the assignee in and to any moneys due or to become due to the Consultant shall be subject to prior liens of all persons, firms, and corporations for services rendered or materials supplied under this contract. Any questions must be sent in writing to purchasing@middlesexcc.edu or submitted through the Opportunity Q&A on the College's bidding portal no later than March 23, 2022 at 4:00 p.m. and will be answered in the form of a clarification. Should any portion of this order and/or services be unfilled or incomplete at the expiration of 60 days from its due date, Middlesex College (College) reserves the right, through written correspondence, to cancel said unfilled portion without liability other than to make payments for that portion of the order that has been delivered in accordance with this award. If an agency or individual(s) responding to this solicitation knows of any material personal interest, direct or indirect, that any member, official or employee of the College would have in the contract resulting from this solicitation, the agency or individual(s) must disclose this to the College. Individual(s) and firms submitting a response to this RFP must comply with all applicable laws and regulations of the State of New Jersey. The Contract shall be in effect from Date of Award and until all conditions of these specifications are met (delivery, maintenance, service, installation instructions, guarantee, etc.). The required response sheet is contained within these specifications. Prospective Consultants shall have the option of inserting prices on any or all items on the response sheet. If a firm stipulates that specified items may be considered only in combination, it must so indicate in the space provided on the response sheet. Awards may be made by item. The award shall be made on the basis of the lowest responsible quotation received which is most advantageous to the College, price and other factors considered. The College agrees to pay the Consultant in current funds for the performance of the contract subject to additions and deductions, said payment to be made within 60 days after such services is completed unless other payment terms are indicated and agreed. The College further reserves the right to request clarification of or to request additional information from any consultant respective to their proposal. The method of contractor selection has not been determined at this time.
