The Town of Wellesley invites bids for the purchase of Road Restoration by Hot-Mix Asphalt Overlay, Cold-Planing and HMA in accordance with the terms of the Invitation for Bid. Prospective Bidders must be prequalified by MassDOT in accordance with 720 CMR 5.00, "Prequalification of Contractors". Bids received by Contractors not on the official or waiver contractor lists issued by the MassDOT Prequalification Office will be considered not qualified and their bid will not be opened. This contract shall be made available for purchases of said materials to other Town of Wellesley Departments and Boards. Each bid shall be accompanied by a bid deposit in the form of a bid bond, certified check, or a treasurer's or cashier's check issued by a responsible bank or trust company, payable to the Town of Wellesley. Bid deposit shall be 5% of the value of the total bid. (Items I, III and V) This contract, in accordance with both Chapter 303, section 60 of the Acts of 2008 and Chapter 10, section 4 of the Acts of 2011, contains price adjustment clauses for diesel fuel, gasoline, liquid asphalt, Portland cement concrete, and steel in the bid documents as are applicable. The base price on this project will be based on the most recent published price at the release of the contract documents. This price adjustment shall be based on the Massachusetts Department of Transportation pricing and will be clearly noted on the Information for Bidders section of the contract documents. No such envelope shall contain more than one bid. The Department of Public Works reserves the right to accept any bid item or combination of bid items or reject any or all proposals, as in its sole judgment, the best interest of the Town of Wellesley would be served by so doing. Prior to execution of a contract, a Payment Bond in the amount of fifty percent (50%) of the total estimated price and of a surety company qualified to issue bonds in the Commonwealth will be required to be furnished by the Contractor to the Town of Wellesley as security for payment by the Contractor and Subcontractor for labor, materials, rental of equipment and for such other purposes as are set forth in the General Laws, Chapter 149, Section 29 and Chapter 30, Section 39A and all amendments thereto. Prior to the execution of a contract, a Performance Bond in the amount of one hundred percent (100%) of the value of the contract and of a surety company qualified to issue bonds in the Commonwealth will be required by the Contractor to the Town of Wellesley to ensure faithful performance of the Contract. The Contractor shall carry and maintain until after completion of the contract, insurance as specified in this document. It shall protect the TOWN and any subcontractor performing work covered by this contract from all claims and liability for damages for personal injury, including accidental death, and for property damage which may arise from operations under this contract. As part of this contract, attached hereto, is a Certificate of Non-Collusion that must be signed. Failure to do so by a duly authorized representative will automatically disqualify said bid, making its submission null and void Should the successful bidder fail to perform its agreement to furnish the required bonds and insurance certificates required herein, the Bid Deposit shall become and be the property of the Town as liquidated damages; provided that, the amount of the Bid Deposit which becomes the property of the Town shall not, in any event, exceed the difference between its bid price and the bid price of the next lowest responsible and eligible bidder. Any such bid that is accepted by the Department must continue in full effect until December 31, 2022, at which time the contract will expire. This is a unit price contract. The Contractor agrees to provide to the Town items at the specific price points listed in the Contractors bid submission, for the duration of the contract.
