This agreement will be a two-year Small Public Works Agreement for hauling, disposal or recycling of wastes generated by maintenance activities conducted by the Public Works Operations Department such as street sweeping, catch basin cleaning, ditching, trenching and concrete or asphalt removal. These services will be performed by the Contractor, on behalf and at the request of the City of Issaquah Public Works Operations Department, during the contractual period. The Contractor shall provide service to the City within 48 hours when notified. The quantity of material hauled through this agreement is on average 1,500 to 3,000 tons of material annually but may be more or less depending on variables such as flooding or snow events that occur during the contract period which can generate additional volumes of waste. The city analyzes all street wastes for contaminants using third-party vendor and uses the results of the analysis to select the proper disposal site. Sweepings and sediment from stormwater with high levels of pollutants will be disposed of at a regulated landfill selected by the city. Issaquah will be directly billed for the disposal fees by the waste sites, this contract will determine the hourly hauling rates to the site for this service. Proposed Timeline This will be a two-year Small Public Works Agreement from May 1st, 2022 to April 30, 2022 Selection Process Candidates with the necessary expertise and resources to perform the work described herein will be considered. Waiver of Claims Each firm in submitting a response to the Invitation to Bid (ITB) is deemed to have waived any claims for damage by reason of selection of another bid and/or rejection of their bid. The ITB does not obligate the City to pay any cost incurred by respondents in the preparation and submission of a response. Additionally, the ITB does not obligate the City to accept or contract for any expressed or implied services. The City of Issaquah reserves the right to reject any and all submittals. Contract Award The City reserves the right to make an award without further discussion of the bid submitted. Therefore, the bid should be initially submitted on the most favorable terms. The City shall not be bound or in anyway obligated until both parties have executed a Small Public Works Agreement. All firms that submitted a bid will be notified in writing of the final contract award decision For your information, a sample Small Public Works Agreement is provided (Attachment A). This document is for informational purposes only, do not submit this as part of your bid. Attachment A includes information on non-discrimination, insurance requirements, business registration and taxation, and compliance with laws and regulations that are required for a vendor to contract with the City of Issaquah If the City and the lowest bidder are unable to reach final agreement, the City may terminate negotiations with the bidder and begin negotiations with the next highest bidder or may make no award and terminate all negotiations. A final contract must be executed prior to initiating any work. Title VI The City of Issaquah hereby gives public notice that it is the policy of the City to assure full compliance with Title VI of the Civil Rights Act of 1964, as amended, the Civil Rights Restoration Act of 1987, Executive Order (E.O.) 12898, and related statutes and regulations in all programs and activities. Title VI requires that no person in the United States of America shall, on the ground of race, color, national origin, or sex be excluded from the participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the City receives Federal financial assistance. Any person who believes they have been aggrieved by an unlawful discriminatory practice under Title VI has a right to file a formal complaint with the City of Issaquah. Any such complaint must be in writing and filed with the office of the City Clerk within one hundred eighty (180) days following the date of the alleged discriminatory occurrence
