When the contract amount is $50,000 or more, a payment bond in an amount of not less than one hundred percent (100%) of the contract price, conditioned upon payment to all persons supplying labor and materials, shall be executed by the successful bidder prior to beginning any work and shall accompany the signed contract. When the contract amount is $25,000 or more, a bidder's bond from an acceptable surety company, authorized to transact business in the State of Texas or a certificate or cashier's check on a state or national bank of the State of Texas, in the amount of not less than five percent (5%) of the total bid must accompany each bid or proposal as guarantee that, if awarded the bid, the bidder will within ten (10) calendar days after award of bid enter into contract with the City. This contract shall become effective from date of acceptance and approval by the City of Bryan. It shall remain in full force and effect with firm fixed bid prices for a period of twelve (12) months.
