Purpose This project has been identified as being necessary to allow the proposed 1% annual chance flood level (37-foot river gage height) to pass through Fargo, without any emergency measures, once the Fargo-Moorhead Diversion Project (Diversion) is completed. Prior to the Diversion being completed and allowing both drainage areas to be in a pump condition during those high water events in the drain. NOTE: This Project is using SRF Loan Funds and Federal Funds and there are additional terms and conditions required to comply with the contract specifications. Please confirm all requirements are met and documents are included with your bid. This Project will comply with SRF and Federal requirements. In the event of a discrepancy between City of Fargo contracting requirements and SRF and Federal contracting requirements, the SRF and Federal contracting requirements shall prevail. Project Location is at 42nd Street South and Drain #27 Convergence Area, North and South Side of Drain. Paper Bid Submissions: Bids must be in a sealed envelope plainly marked "Lift Station Repl/Rehab, Project No. FM-22-C1", Each paper bid shall also be accompanied, in the outside envelope, by bidder's completed (i) MBE/WBE Subcontractor Solicitation Information form; (ii) Certification regarding Debarment, Suspension, and other Responsibilities form; (iii) DBE Subcontractor Utilization form, and (iv) DBE Subcontractor Performance form. No bid will be opened, read or considered if the outside envelope does not contain the required (1) bid bond; (2) Contractor's license; (3) MBE/WBE form; (4) Debarment form; (5) DBE Subcontractor Utilization form; (6) DBE Subcontractor Performance form; and (7) Acknowledgment of All Addenda (One or more). Any deficient paper bid submitted will be returned unopened to the bidder. All Bid Submissions: All Bidders should be advised that if awarded, the Contractor shall comply with the (i) American Iron and Steel requirements; (ii) Civil Rights requirements; (iii) Equal Employment Opportunity requirements; (iv) create an affirmative action plan; (v) provide evidence of compliance with the Disadvantaged Business Enterprises (DBE) participation; (vi) and provide evidence of compliance with the Davis Bacon Act as more fully set forth in the Contract. Bidders on this work will be required to comply with Title 40 CFR Part 33- Participation by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation concern utilization of Minority Business Enterprises (MBE), Women's Business Enterprises (WBE), and Small Business Enterprises (SBE) and are explained in the specifications. No bid may be read or considered if it does not fully comply with these requirements and any deficient bid submitted must be resealed and returned to the bidder immediately. Plans and specifications are also on file in the office of the City Engineer and the City Auditor, City Hall, Fargo, North Dakota, where they may be examined by any interested person. The Board of City Commissioners of the City of Fargo, North Dakota, reserves the right to hold all bids for a period of thirty days after the first day fixed for the opening of the bids, and the right to reject any or all bids and to waive any formalities.
