Guarantee Period. (This Section does not apply to construction contracts funded with Motor Fuel Taxes administered by the Illinois Department of Transportation.) The Contractor warrants all work performed under this contract is free from defects and was performed in accordance with the Contract Documents for a period of one (1) year from the date of final completion of the work, as accepted in writing, by the City Engineer after all other parties have signed the document. In case of acceptance of a part of the work for use or occupancy prior to the final acceptance of the entire work, the guarantee for the part so accepted shall be for a period of one (1) year from the date of such partial acceptance, in writing, by the City Engineer. Work performed due to this warranty requirement shall be guaranteed for a period of one (1) year. This Section 2.5 may be further amended in Part 3 - Technical Specifications. This Project calls for hydraulic water jet cleaning, root cutting, inspecting/televising City storm sewers (6-inch to 66-inch) and cleaning manholes and inlets. Disposal of removed debris from the sewers and manholes is also a part of the project. This Contract has two phases. Phase 1 consists of cleaning and televising approximately 65,989 linear feet of storm sewers, cleaning 637 manholes/inlets as defined in the project plans. Phase 1 has a target completion of one (1) year from the date of commencement. Phase 2 consist of diagnostic Services that will be performed at the option of the City and will be defined at a later date. Diagnostic Services shall include cleaning and televising of storm sewers with undefined locations and diameters in order to diagnose storm sewer problems that are encountered during Phase 1 of the project. Diagnostic cleaning and televising may occur at any location within the City and at any time during the contract period Each bid shall be accompanied by an acceptable form of Bid Guaranty in an amount equal to at least TEN PERCENT (10%), as a guarantee that if the bid is accepted, the bidder will execute the contract and all other Contract Documents and file acceptable contract bond and proof of insurance within fourteen (14) days after the award of the contract and prior to commencement of work The City of Champaign, Illinois, reserves the right to reject any or all bids or portions thereof and to waive any formality or technicality in any bids in the interest of the City. The criteria for selection of the lowest responsible bidder are set forth in Section 12.5-38 of the Champaign Municipal Code, 1985, as amended and the bid documents. To the extent required by law, the contractor shall comply with the Illinois Prevailing Wage Act, the Veterans Preference Act, the Employment of Illinois Workers on Public Works Act, the City's Equal Opportunity in Purchasing Ordinance and the Illinois Human Rights Act. If federal funds are used to finance this project, the contractor shall comply with the Davis-Bacon Act.
