Bid security shall be submitted with each bid in the amount of [5] percent of the bid amount. No bids may be withdrawn for a period of 45 days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities. Plan deposit is refundable in accordance with the terms in the instructions to bidders to all submitting bids. Any bidder requiring documents to be shipped shall make arrangements with the printer and pay for all packaging and shipping costs. All bid addenda will be transmitted to registered plan holders via email and will be available at portal. Plan holders who have paid for hard copies of the bid documents will need to make the determination if hard copies of the addenda are required for their use, and coordinate directly with the printer for hard copies of addenda to be issued. There will be no charge for registered plan holders to obtain hard copies of the bid addenda. B. Please note revplans is the designated location and means for distributing and obtaining all bid package information. Only those contract documents obtained in this manner will enable a prospective bidder to be identified as an official plan holder of record. The provider takes no responsibility for the completeness of contract documents obtained from other sources. Contract documents obtained from other sources may not be accurate or may not contain addenda that may have been issued c. A bidder, upon 1) making the deposit required for the bid documents, 2) submitting a proposal accompanied by a certified check or other security in accordance with the requirements contained in the plans and specifications and public advertisement for bids, and 3) returning the plans and specifications used by such bidder in good condition within thirty (30) days following the award of the contract, or rejection of the bid, shall have returned to them the full amount of the deposit for one copy of the plans and specifications online procurement and contracting documents Bidder's qualifications attention of the bidder attention of the bidder is particularly called to the owner's sales tax exemption, the requirements as to conditions of employment to be observed, and the minimum wage rates to be paid under the contract. The owner further reserves its right to disqualify bidders for any material failure to comply with the "instructions to bidders". 6.02 this contract is subject to a project labor agreement this contract is subject to a project labor agreement ("pla") entered into between the newburgh enlarged city school district ("owner") and the hudson valley building and construction trades council, on behalf of itself and its affiliated local unions, and the signatory local unions on behalf of themselves and their members. By submitting a bid, the contractor agrees that the pla is binding on the contractor and subcontractors of all tiers. Please refer to the bid documents for further information. The bidder to be awarded the contract, as well as the bidder's subcontractors, will be required to execute a "letter of assent" prior to the award. Failure to execute the letter of assent will result in the rejection of the bidder. The bidder is advised to review the pla and the letter of assent, all of which are attached to aia document a232-2009 general conditions of the contract for construction.
